دور اعتبار المآل في فقه الأقليات المسلمة

الملخص
ملخص البحث يعتبر فقه الأقليات المسلمة فقه خاص؛ لأن الفقيه المفتي يعالج نوعاً خاصاً من الأسئلة التي يزدحم بها الوجود المجتمعي في البلاد غير الإسلامية، ومنشأ الخصوصية راجع إلى طبيعة النظم القانونية للدولة التي يتأطر من خلالها الفضاء الاجتماعي، التي تتولد في مجتمعاتها جملة من الإشكالات، والقضايا التي يطلب من الفقيه الاستدلال على أحكامها الشرعية العملية، والإشكال الأساسي الذي تدور حوله هذه الدراسة هو: ماهي ضرورة اعتبار المآل عند التشريع لفقه الأقليات؟ وما هو تأثير خصوصية الأقليات على اعتبار المآلات؟. والحق أن مشكلات الأقليات المسلمة لا يمكن أن تواجَه إلا باجتهاد دقيق، ينطلق من كليَّات القرآن الكريم وغاياته وقيمه العليا، ومقاصد شريعته؛ لأن الأحكام الشرعية تبنى في صيغتها النظرية المجردة أمرا ونهيا، على اعتبار ما تؤدي إليه مآلاتها من الأفعال، باعتبار أجناسها المجردة، من مصلحة أو مفسدة. ولهذه القاعدة الأصولية ( اعتبار المآلات ) مجال استعمال واسع، في المعالجة الفقهية لأحوال الأقليات المسلمة بالبلاد الأوربية؛ ذلك لأن أحكام الشريعة في مجال التعامل الاجتماعي، جاءت في عمومها أحكاما تعالج أوضاع تلك العلاقات، وكانت تلك المعالجة الشرعية مبنية على وضوح في مآلات الأفعال المحكوم عليها. ولقد اخترت منهجا للبحث كانت طبيعة الموضوع هي الحاكمة على اختياره في هذه الدراسة، فكان لزاما ّ علي إتّباع المنهج الاستقرائي؛ وذلك بتتبع مواطن بحث الفقهاء في مسائل فقه الأقليات المسلمة، ومن ثمّ جمع المادة العلمية المتعلقة بها، وكذا المنهج التحليلي الوصفي المناسب لموضوع البحث للنظر في أقوال الفقهاء ووجوه استدلالاتهم، ثم تحليلها واستخلاص النتائج منها. ومن أهم نتائج هذا البحث مايلي: 1- على المجتهد أن يقـدر مـآلات الأفعال التي هي محل حكمه وإفتائه، وأن يحكم في الفعل وهو يستحضر مآله و آثاره. 2- إن وضع الأقليات المسلمة في الدول الغربية، يجعل التعامل مع مصطلح «الأقليات» أمرا لا مفر منه. وهذا الوضع يجعل المصطلحات الإسلامية القديمة غير مفهومة اليوم، وهنا تبرز صعوبة التأسيس والاجتهاد لوضع جديد ربما يكون غير مسبوق، مما يحتاج لتخريج فقهي وسياسي مختلف عن ذلك الذي عرفه الفقه الإسلامي. ومن أهم التوصيات: 1- إنشاء مؤسسات بحثية متخصصة تعمل على تطوير فقه الأقليات وفق أحوال المهاجرين. 2- دعم المراكز الإسلامية بالغرب لمتابعة شؤون الأقليات الإسلامية ومساعدتها على إيجاد الحلول لمشاكلها. - الكلمات المفتاحية الأقليات، فقه الأقليات المسلمة، فقه المآلات، اعتبار المآل. Abstract The jurisprudence of Muslim minorities is regarded as special; Because the Mufti jurisprudence addresses a particular kind of question with which the community presence in the non - Islamic country is crowded, and the origin of privacy is due to the nature of the legal systems of the State through which social space is framed, in whose societies a number of problems are generated, and to the issues in which the jurisprudence is required to infer its provisions of practical legitimacy. The main problem around which this study revolves. What is the need to consider money when legislating for the jurisprudence of minorities? And what is the impact of the privacy of minorities on considering the outcomes? The right to the problems of Muslim minorities can only face an accurate diligence, which will be launched from the colleges of the Holy Quran and its upper values, and the purposes of its Sharia and the right ...; Because the legitimate provisions are adopted in their naked theoretical formula, as well as their acts of acts, as their naked and corrupt methods. This rule of fundamentalism (atbar maalat) is a wide area of use, in the doctrinal treatment of the situation of Muslim minorities in the European countries, because the provisions of sharia in the field of social dealing, generally came provisions dealing with the conditions of those relationships, as relations governed by the Sultan of religion, within the Muslim nation among some of its members and groups, or within the scope of its relationship as a Muslim nation with peoples, nations and non-Muslim States, and that legitimate treatment was based on clarity in the outcome of the condemned acts. Among the results of this search 1_The mujtahid must estimate the consequences of the actions that are the subject of his ruling and fatwa. _2The situation of Muslim minorities in Western countries makes dealing with the term “minorities” inevitable. Recommendations 1_Establishing specialized research institutions that work on developing the jurisprudence of minorities according to the conditions of immigrants. _2Supporting Islamic centers in the West to follow up on the affairs of Muslim minorities and find solutions to their problems. - key words minorities, fiqh Muslim minorities, fiqh almal, Consideration almal.
