الملخص
تناولت في هذا البحث الموسوم بـــ: "الضرورة الشرعية وتطبيقاتها المعاصرة على فقه الأقليات المسلمة أحكام المعاملات أنموذجا" مفهوم الضرورة الشرعية وأصولها من القرآن والسنة، ثم أَجليتُ الغبار على طبيعة فقه الأقليات المسلمة وبنيت أهدافه وحبل الوصال الذي يربطه بالضرورة، ثم وقفت على بعض النوازل التي ألمّت بالجاليات المسلمة وكانت الضرورة الشرعية هي الرخصة للخروج من عُنق الزجاجة حيث ذكرت بعض النماذج التطبيقية في باب المعاملات عموما، وعرّجت على بعض القضايا التي تدخلها الضرورة الشرعية في مجال السياسة الشرعية ومجال المعاملات المالية وكذلك الأطعمة والأشربة ثم الأحوال الشخصية، حيث استنتجت في الأخير أن الضرورة حالة واقعية في حياة الأقليات المسلمة في المُهَاجَر ينبغي مراعاتها في منظومة الإفتاء والاجتهاد في نوازل الأقليات المسلمة. Summary: In this research l talked about legal necessity and it s modern application in jurisprudence of Muslims minorities, transaction provisions as a model, the definition of legal necessity and its origins from Quran and Sunnah, controls which should be offered to realize the meaning of necessity, in addition to that l omit dust on the definition of jurisprudence of Muslims minorities, l build its aims and the connecting rope which relates it with necessity, l have stopped on some hostels that hosts Muslims community. Legal necessity was the license to exit from the neck of the bottle, l also mentioned some practical models in transactions section in general, in addition to that l have stopped on some issues which are included by legal necessity in the field of legimate politics and in the field of financial transactions, adding to that food and drinks than the personal status. At the end l conclude that necessity is a real case in muslims minorities life in immigrant which should be observed in issuing fatwa, also delegence in Muslims minoritien hostels.
