متطلبات الفتوى في النوازل الطبية وضوابطها ومستندها

الملخص
النازلة الطبية هي:" الوقائع الطبية المستجدة التي يحتاج الناس فيها إلى فتوى شرعية"، وهي بحاجة إلى: المقدرة على الاجتهاد وفق آلياته، والتزام الأصول العامة في الشريعة : "جلب المصالح ودرء المفاسد"، مراعاة الثابت والمتغير من الأحكام، مبدأ اليسر ورفع الحرج، كما كشف البحث أن الفتوى في النازل الطبية تقيد بالضوابط الآتية: التصوير من أهل الاختصاص، فهمه من الفقيه، وتأصيلها وفق نظرٍ صحيحٍ معتبرٍ لأصول التشريع، ودون الإلزام بأصول مذهب بعينه، مع الحرص على جماعية الفتوى، كما انتهى البحث إلى تقرير الأصول الآتية مستندًا للفتوى في النازلة الطبية: الأصول المقرر شرعا الرجوع إليها في إصدار الأحكام الشرعية قضاء و فتوى وتقريرا للمسائل، الأدلة التبعية، القواعد العامة في الشريعة ومقاصدها؛ كقاعدة المقاصد و الضرر واليقين والمشقة، والموازنة بين المصالح والضار، وبين بعضها العض قوة وضعفًا، و النظر في المقاصد والمآلات. Medical Catarrh: the emergence of new diseases at an individual or a group level that were unknown. The requirements of Fatwa in medical catarrh: • The ability to diligence. • The provisions of medical catarrh do not deviate from the general principle in Sharia, which is: “Bringing benefits and warding off harm.” • Taking into account the fixed and variable rulings, and knowing the ruling of time Fatwa constraints in the medical catarrh • Professionals’ describing of the medical catarrh before the diligent issues a ruling on it • The rooting of the medical catarrh according to a valid and considered view of legislation principles • Not adhering to the fundamentals of a particular school of thought in order to issue fatwas regarding catarrhs, when this leads to distressed, embarrassed, or obstinate patient or the doctor. • Ensuring a collective fatwa regarding medical catarrhs • Considering values and morals • The fatwa basis in the medical catarrh: • Refer to the legally established principles in issuing Sharia rulings in terms of judiciary and fatwas • Approbation, Pardoned interests • General rules in Sharia and its purposes The general rules and purposes of the Sharia, and the observer of a medical catarrh must also take into account the consequences of actions in the medical fiel
