أسباب الإباحة ومستندها على ضوء الشريعة الإسلامية والتشريع الجزائري

الملخص
ملخص: تهدف هذه الدراسة إلى إبراز القيمة العلمية العملية "للأسباب الإباحة"، كأسباب تنتفي مع وجودها علة التجريم، فـهي تعطل النص التجريمي، وتوقف العمل به؛ و بموجبها يرتفع الحظر عن الأفعال المجرمة بالنص استثناء، ويعود التجريم لأصـله بعد زوالها. وهذا المعنى يكاد يكون متقارب بين الشريعة الإسلامية والقانون الجزائري، إلا أن دائرة استعماله قانونيا ضيقة؛ فلا يستعمل إلا في إطار قانون العقوبات، الذي يرتبط بالنظام العقابي؛ أما الشريعة الإسلامية فتستعمله في مسـائل الضـرورات؛ في العـبادات والمعاملات والجنايات. وتستند أسباب الإباحة إلى النص المتضمن للحالات التي ترد كاستثناء على النص التجريمي، وهي حالات محصورة ومبينة بنص، حتى لا يمكن التذرع بها قضاء، كما تستند إلى المصلحة الجديرة بالحماية والمتمثلة في الحق الراجح في إطار مقاصد الشريعة الإسلامية، وما تتضمنه القاعدة القانونية من حق للمجتمع يستلزم حمايته. Abstract: This study aims to showing the practical scientific value of “permissive reasons”, as reasons that deny their existence the cause of criminalization, as they disrupt the criminal text and stop working with it; And according to it, the prohibition of the acts criminalized by the text is lifted as an exception, and the criminalization returns to its origin after its demise. This meaning is almost close to Islamic Sharia and Algerian law, but the scope of its legal use is narrow; It is used only within the framework of the Penal Code, which is related to the penal system; As for Islamic Sharia, it uses it in matters of necessities In acts of worship, transactions, and felonies. The reasons for permissibility are based on the text containing the cases that are included as an exception to the criminal text, which are limited and indicated by text, so that they cannot be invoked by the judiciary, and are also based on the interest worthy of protection represented in the preponderant right within the framework of the purposes of Islamic Sharia, and the legal rule of the right of society It requires protection.
