قوادح الاستدلال بقول الصحابي والجواب عنها عند الإمام الباجي مِنْ خلال كتابه "المنهاج في ترتيب الحجاج"

الملخص
لـمَّا كان الاستدلال الشَّرعيُّ منوطا بقواعدَ وضوابطَ؛ ليصحَّ اعتبارُه، وكان معرفةُ ما يُقدح به وما يجاب به عنه مرتَّبًا على نَمَطٍ؛ ليَسْلمَ الدليل ويتمحَّص اختبارُه، ومِن جملة ما يُستدل به كثيرا في كتب الخلاف دليل قول الصحابي؛ كان لابدَّ من أسئلة واعتراضات تُورد عليه ليستقيم عِيارُه؛ إذ لا ينفكُّ -كغيره من الأدلة الشرعية- من التَّمييز والتَّمحيص، حتى تقوم به الحجَّة وتتَّضح المَحَجَّة. وإنَّ مِنْ أَجَلِّ المعتنين بهذا العلم العظيمِ إمامُ الأندلس وفخرُها، العلاَّمة النَّظَّار أبو الوليد الباجي رحمه الله، حيثُ جلَّى رحمه الله في كتابِه البديع "المنهاج في ترتيب الحجاج" -باكورةِ كتبِ المغاربةِ الجدليَّة- طرقَ الحِجَاجِ وقواعدَ المناظَرَة، واستقرأ مادَّته من الكتاب والسُّنَّة ومناظرات الصَّحابة، مِن أجل تعليم المتفقِّهة تمحيصَ الأدِلَّةِ الشَّرعيَّةِ بالقواعد الجدليَّة، فحاول الباحث في هذه الدِّراسة إبراز أهمِّ المعالم النَّظرية لقوادح الاستدلال بقول الصحابي وأجوبتها عند الإمام الباجي رحمه الله من خلال كتابه "المنهاج في ترتيب الحجاج" ومقارنتها بما قرَّره العلماء قبله، مع بيان العلاقة بين القوادح الواردة على الاستدلال بقول الصحابي وبين القوادح الواردة على الاستدلال بغيره من الأدلة النقلية، ممَّا يُسهم في الاستثمار الأكمل لأبواب التَّرجيح عند تعارض أقوال الصَّحابة فيما بينها بسبرها وتمحيصها؛ لمعرفة أقواها والأخذ به. The Shariah legal reasoning is dependent on rules and regulations, and knowing what is used in argument and responds is arranged according to a pattern; to accept the evidence and examine its test, and among what is inferred a lot in the books of argument is the evidence of the saying of the Companion; as such, Questions and objections had to be presented to this reason in order to straighten out it standard; because like other legal evidence, It is not free of .discrimination and scrutiny, until the argument is established and becomes clear And one of the prominent scholars in this field was Imam of Andalusia and its pride Abu Al-Walid Al-Baji, as he clarified in his wonderful book "Al-Minhaj fi Tartibil Al-Hijjaj" -the first of Moroccan polemical books- he discussed reasons and the rules of debate, and he extrapolated the content of the book from the Quran and Sunnah, and debates Companions, in order to teach the scolars how to scrutinize legal evidence with dialectical rules. In this study, the researcher tried to highlight the most important theoretical features of the argument with the saying of the Companion and their answers according to Imam Al-Baji, through his book "Al-Minhaj fi Tartibil Al-Hijjaj" and compared them with what the scholars before him decided, with an explanation of the relationship between the argument on the inference of the saying of the Companion and with other textual evidence, which contributes to the most usefulness of the chapters Weighting when the sayings of the Companions conflict with each other by examining and scrutinizing them.
