واقع العلاقة بين السلطة التنفيذية وسلطتي التشريع والقضاء في الجزائر على ضوء التعديل الدستوري لسنة 2020

الملخص
إن الغاية الاساسية من وضع الدساتير هو معالجة الاوضاع القائمة، والتطلع لإقامة نظام ديمقراطي من خلال تأطير الممارسة السياسية وتحديد العلاقة بين السلطات كأهم مبدأ لتكريس ما يعرف بدولة القانون، فالديمقراطية تعني نظام الحكم الذي يعطي السيادة للشعب بحيث يكون صاحبها ومصدرها والأهم من ذلك ان تمارس بصورة فعلية. غير ان الامر في الجزائر مختلف فدراسة العلاقة بين الهيئتين التنفيذية والتشريعية يظهر جليا لنا تفوق السلطة التنفيذية ومنح امتياز عضوي ووظيفي واضح لها على حساب البرلمان بحيث يمكن اعتباره المشرع الرئيسي والأساسي، كما تكمن أهم أليات تحكمها في مؤسسة القضاء في تلك التي تجعل منها الجهة المتحكمة في اهم اجهزتها ووظائفها. The most important mechanisms governing the judiciary are those that make it Control of the most important organs and functions.
