المفاوضات كآلية جديدة لإقتسام موجودات و عائدات الفساد المستردة

الملخص
تهدف دراستنا إلى تسليط الضوء على إمكانية إعتماد المفاوضات كآلية جديدة لإقتسام عائدات الفساد المستردة في إطار التصرف فيها، و إلى بيان مدى نجاعة هذه الآلية في توفير متطلبات مكافحة الفساد المكلفة و خلق حوافز مستقبلية للتعاون الدولي في ذات الإطار، و خلصت إلى ضرورة إعتمادها و التشجيع عليها و مواصلة البحث فيها لتحديد أطرها و سبلها كونها ذات طابع خاص يختلف عن المفاوضات الدبلوماسية (كوسيلة سلمية لحل النزاعات الدولية)، و لما لها من أثار إيجابية مستقبلا على تعزيز التعاون الدولي في مجال مكافحة الفساد و في القضاء على الملاذات الدولية لتحويل عائدات الفساد. This study aims at shedding light on the possibility of adopting negotiations as a new mechanism to divide the recovered proceeds of corruption in the light of disposal. Moreover, the study focuses on the extent of the success of this mechanism in providing the costly requirements of fighting corruption and in creating future incentives for international cooperation in the same context. Findings show the necessity of adopting this mechanism, encouraging its use, and continuing research in it to identify its frames and ways because it has a specific nature that differs than the diplomatic negotiations (as a peaceful tool for conflict resolution) and has future positive effects on the strength of the international cooperation against corruption and the international destinations to transfer the corruption proceeds.
