الملخص
ملخص: يرتبط موضوع هذه الورقة البحثية بمجال القانون، نهدف من خلالها التعرض لموضوع الشراكة بين القطاع العام والقطاع الخاص باعتباره يشكل مظهرا من مظاهر الدولة الحديثة، ارتبط ظهوره بموجة التغيير العالمية المرافقة لانهيار النظم الاشتراكية وبروز التطبيقات الحديثة للنظم الرأسمالية، التي تطالب بتوسيع نطاق المبادرات الخاصة، وحرية المنافسة، إلى درجة يصعب معها حصر مجالات تدخل القطاع الخاص في النشاط. فالشراكة بين القطاعات في إطار الدور الاقتصادي الجديد للدولة، تشكل ركيزة من ركائز الإصلاح الاقتصادي في الجزائر، وباعث من بواعث التغيير في السياسة التشريعية، بحيث يمنح الدولة فرصة لتحديث وتطوير أنماط وأساليب عملها، وكذا تدخلها في مجال تنفيذ المشروعات العامة، غير انه كفكرة يحمل في تطبيقاته كسلوك قانوني جملة الإشكالات القانونية، التي ستشملها دراستنا من خلال هذه الورقة. Abstract: The term of the present research paper is related to the area of law, we target through it to present the topic of the public-private partnerships), considered as one of the manifestations of the modern state. Its appearance is linked to the global wave of change accompanying the collapse of socialist regimes and the emergence of modern applications of the capitalist regimes, which require the expansion of private initiatives and the freedom to compete that. The partnership between sectors in the new economic role of the state is one of the pillars of the economic reforms in Algeria, and one of the causes of changes In the legislative policy, that it gives to the state an opportunity to modernize and develop its working methods, regarding the magnitude of the projects, However, as an idea it involves a range of legal issues in its applications as legal conduct, which will be covered in our study.
