التصنيف العقابي لنزلاء مؤسسات السجون بين أهداف العقوبة وحقوق الإنسان

الملخص
أكدت العديد من الاتفاقيات والمعاهدات الدولية ذات الصلة بحقوق الإنسان على ضرورة تصنيف نزلاء مؤسسات السجون بما يتماشى والسياسة العقابية المعاصرة من أجل تحقيق الهدف الأساسي من العقوبة السالبة للحرية وهو إصلاح السجين وتهذيب سلوكه وإعادة إدماجه اجتماعيا، ويستدعي ذلك أن يتم تصنيف الفئات من السجناء وفق معايير وأسس علمية تحفظ حقوق كل فئة حسب خصوصياتها ومميزاتها انسجاما مع المبادئ والأساليب المعاصرة التي أقرتها المعايير الدولية لمعاملة السجناء. والجزائر ومن خلال ما انتهجته من سياسة عقابية تعتبر من التشريعات السباقة في الأخذ بنظام التصنيف العقابي بما كرسته من أجهزة وهيئات لهذا الغرض وحماية حقوق السجين والعمل على إصلاحه وإعادة إدماجه اجتماعيا بموجب القانون رقم 04/05 المتضمن قانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين والذي جاء تماشيا مع غاية الفكر العقابي المعاصر. Abstract: Many international conventions and treaties related to human rights have affirmed the need to classify inmates of penitentiary institutions in line with contemporary penal policy in order to achieve the main objective of the punishment of depriving freedom, which is reforming the prisoner, refining his behavior, and reintegrating him socially. This calls for classifying groups of prisoners according to scientific standards and principles that preserve the rights of each group according to its peculiarities and characteristics, in line with contemporary principles and methods assigned by international standards for the treatment of prisoners. Algeria, through its punitive policy, is considered one of the first legislations in the introduction of the punitive classification system; with the agencies and bodies devoted to this purpose of protecting the rights of the prisoner, and working to reform and reintegrate him socially according to Law No. 05/04 that includes the law on organizing prisons and the social reintegration of inmates.
