حول إلزامية رد المحكمة العليا على كافة أوجه الطعن بالنقض

الملخص
الملخص: إن تتبع أدق تفاصيل المجهود الجبار الذي يبذله القاضي في عمله الدؤوب يستوجب العناية أساسا والحرص على إيلاء الأهمية البالغة بعمل أعلى هيئة ممثلة في المحكمة العليا، طالما أنها آخر محطة يتوقف عندها مآل كل القضايا المدنية منها والجزائية، ويستوجب الأمر التعرف على جهة النقض وكيف تمارس صلاحياتها لا سيما في مناقشة والرد على أوجه الطعن بالنقض التي يقدمها الطاعن ضمن مذكرة الطعن، والفصل في وجه واحد فقط الذي يؤدي إلى النقض والإحالة والتغاضي عن باقي الأوجه دون مناقشتها والرد عليها، ومن خلال هذه الدراسة نحاول البحث عن دواعي هذا العرف القضائي ومبرراته القانونية والواقعية. Abstract: Tracing the smallest details of the great effort made by the judge in his diligent work requires care mainly and keenness to give great importance to the work of the highest body represented in the Supreme Court, as long as it is the last station at which the fate of all civil and penal cases, depends, and it is necessary to know the point of cassation and how It exercises its powers, especially in discussing and responding to the aspects of cassation submitted by the appellant within the memorandum of appeal, and adjudicating in one aspect only that leads to cassation, referral and ignoring the rest of the aspects without discussing and responding to them, and through this study, we try to search for the reasons for this judicial tradition and its legal and factual justifications.
