الاقتصاد والقانون: علاقة تنافر أم تجاذب؟ "economics And Law: Relationship Repulsion Or Attraction?"

الملخص
ينظر إلى علم الاقتصاد، عموما، على أنه علم من العلوم الاجتماعية، ومعنى ذلك أنه يتعلق بأحوال الأشخاص والمجتمعات، وبالتالي تتغير الحلول الاقتصادية بتغير أحوال هؤلاء الأشخاص وهذه المجتمعات، فما يصلح لشخص أو مجتمع ما، قد لا يصلح لشخص أو مجتمع آخر، وهنا يتقاطع علم الاقتصاد مع علم القانون، على اعتبار أن هذا الأخير علم اجتماعي بامتياز، يضع قواعد بغرض تنظيم المجتمع في شتى المجالات بما فيها المجال الاقتصادي. ولا شك أن السؤال المحوري الذي يطرح نفسه في هذا الإطار يتمثل في معرفة أوجه العلاقة بين العلمين سواء من حيث اللغة والمصطلحات التي يتميز بها كل واحد منهما أو من حيث الأدوات الخاصة بكل منهما في التحليل وقياس النتائج المحققة. ذلك ما تحاول هذه الورقة الإجابة عنه، من خلال البحث في تطور العلاقة بين الاقتصاد والقانون (القسم الأول)، ثم محاولة البحث في التأثير البين للاقتصاد على بعض الفروع القانونية (القسم الثاني). Economics is, generally regarded as a social science. This means that it relates to the conditions of persons and societies. Thus, economic solutions change according to the changing conditions of these people and societies. What works for one person or society may not be suitable for another person or society. Here, the science of economics intersects with the science of law, given that the latter is a social science par excellence, which sets rules, to organize society in various fields, including the economic field. Undoubtedly, the pivotal question that arises in this context is to know the aspects of the relationship between the two sciences, whether in terms of language and terminology that characterizes each one of them or in terms of the tools specific to each of them in the analysis and measurement of the achieved results. That is what this paper attempts to answer, by researching the evolution of the relationship between economics and law (first section), and then trying to research the apparent impact of economics on some legal branches (second section).
