The Relationship Between Islamic Law And Roman Law العلاقة بين الفقه الإسلامي والقانون الروماني

Abstract
Both Islamic law and Roman law are ancient legislations that were adopted in many countries as a basis for codification and governance, and work with them spread in many countries, and each law has its origins, principles and writings, but not long ago, some Orientalists appeared who claimed that Roman law had influenced Islamic law differs between the orientalists in this regard, between those who claimed that Islamic law was influenced by some principles of Roman law and those who claimed that Islamic law is nothing but Roman law in an Islamic guise, while some of them denied this claim and admitted that Islamic jurisprudence had nothing to do with Roman law. Its principles and principles, however, it became clear to us through the presentation of the semi-Orientalists and the response to them that many of the Orientalists only want to distort Islamic law , While also many orientalists were objective in their studies and recognized Islamic law as independent in principles and rules, and that it is a jurisprudence comparable to Roman law in originality and precision of workmanship. يعد كل من الفقه الإسلامي والقانون الروماني من التشريعات العريقة التي اعتمدت في كثير من البلاد كأساس للتقنين والحكم ، وانتشر العمل بهما في كثير من البلدان ، ولكل قانون أصوله ومبادئه ومؤلفاته ، لكن منذ زمن ليس بالبعيد ظهر من المستشرقين من ادعى أن القانون الروماني قد أثر في الفقه الإسلامي على اختلاف بين المستشرقين في ذلك بين من ادعى أن الفقه الإسلامي قد تأثر ببعض مبادئ القانون الروماني وبين من ادعى أن الفقه الإسلامي ما هو إلا القانون الروماني في ثوب إسلامي ، في حين تنكر بعضهم لهذا الادعاء واعترفوا بأنه لا علاقة للفقه الإسلامي بالقانون الروماني فلكل مبادئه وأصوله ، غير أنه تبين لنا من خلال عرض شبه المستشرقين والرد عليها أن الكثير من المستشرقين إنما يريدون تشويه الفقه الإسلامي لا غير ، في حين أن الكثير أيضا من المستشرقين كانوا موضوعيين في دراستهم واعترفوا للفقه الإسلامي بالاستقلالية في المبادئ والأصول ، وأنه فقه يضاهي القانون الروماني في الأصالة وإحكام الصنعة .
