المقاصد العامة في مكافحة الفساد - مقارنة بين الشريعة والقانون - - Headeline :general Objectives In Fighting Corruption - Comparison Between Law And Islam

الملخص

يتضمن المقال العلمي الذي بين أيدينا البحث في مدى اعتبار كلا من الشريعة الإسلامية والقانون الوضعي للمقاصد العامة والغايات الكبرى من خلال مكافحة الفساد والتصدي له، وذلك إجابة على إشكالية هل اعتبرت الشريعة والقانون للمقاصد عند مكافحة الفساد؟، وقد تم معالجة تلكم الإشكالية من خلال مبحثين أساسيين، تضمن المبحث الأول منهما النظر في مفاهيم عناصر حدود الدراسة في كل من الشريعة والقانون، وتضمن المبحث الثاني منهما التجلية التامة لمعنى المقاصد العامة والغايات الكبرى مع الإشارة إلى أقسام من المقاصد الأخرى، ثم جاء التفصيل الذي بحث في إثبات أن الشريعة والقانون كلا منهما قد اعتبر المقاصد العامة من خلال مكافحتهما للفساد، وأولاها أهمية كبيرة، ليكون الختام بمقارنة بين اعتبار المقاصد العامة عند فقهاء الشريعة وبين اعتباره عند فقهاء القانون، ومدى توافقها أو اختلافهما، وبناء على ذلك تم استخلاص مجموعة من النتائج والتوصيات التي تم تدوينها في الأخير. This scientific article in our hands consits on searching the vision of islamic regulation and positive legislation toward the general objectives and finalities of fighting corruption .In order to answer this problematic which is « do islamic legislation and positive regulation took in consideration the finalities to fight corruption .This problematic was analysed on two pricipal topics ,the first one is searching the notions and elements based on the limits of analysis treated by the islamic legislation and the positive regulation.The second topic is the total signification of this finalities and generals purposes and how they are manifested in fighting corruption,also we may mention other purposes . Aterthat comes details which search in confirming that islamic legislation and positive law take in consideration the general targets and give them great importance against fighting corruption . finally we take in consideration the comparison between the general objectives at the islamic legislation jurists and the positive law jurists and how they are concomitant between each other and how they are diffirent from each other .accordinglly we deduce set of results and recommendations that will be mentioned after.
