تأثير تقرير الطب الشرعي على سير إجراءات الدعوى العمومية

الملخص
يعتبر الطب الشرعي من أهم العلوم الطبية الحديثة التي يستعان بها في مجال الإثبات الجنائي؛ إذ يساهم في معرفة أسباب الجريمة وتاريخ حدوثها. وقد ساوى المشرع الجزائري بين هذا الدليل والأدلة الأخرى في القيمة الثبوتية، كما جعل الأعمال المنجزة من قبل أعضاء الضبطية القضائية لا ترقى إلى مرتبة الخبرة، وإنما تبقى مجرد معاينات فقط، ومنحها التأثير على سلطة الاتهام لدرجة أنه يتحكم في تكييف الجريمة، ويوجه قناعة النيابة العامة في تحريك الدعوى العمومية، أما في مرحلتي التحقيق والحكم فللقاضي سلطة تقدير الخبرة الطبية الشرعية بكل حرية. Abstract: Forensic medicine is one of the most important modern medical sciences that is used in the field of criminal proof. It contributes to knowing the causes of the crime and the date of its occurrence. The Algerian legislator has equated this evidence with other evidence in the probative value, and made the works carried out by the members of the judicial police do not rise to the rank of expertise, but remain only previews, and give them influence on the authority of the accusation to the extent that it controls the adaptation of the crime, and directs the conviction of the Public Prosecution In the initiation of the public lawsuit, but in the stages of investigation and judgment, the judge has the power to freely assess forensic medical expertise.
