مقرر التأشيرة آلية رقابية بين الإلزام والتجاوز في مجال الصفقات العمومية

الملخص
يعد منح أو رفض التأشيرة، الآلية القانونية التي كرسها المنظم الجزائري لصالح لجنة الصفقات العمومية المختصة، المنصوص عليها بموجب أحكام الباب الأول الفصل الخامس المعنون برقابة الصفقات العمومية، لاسيما القسم الثاني منه المتضمن هيئات الرقابة الخارجية القبلية للصفقات العمومية من المرسوم الرئاسي 15-247 لأجل ممارسة مهامها الرقابية في إطار الدور الإداري الرقابي الخارجي المنوط بها، لذا لا يمكن تصور إبرام أو تنفيذ صفقة عمومية دون الحصول على التأشيرة، إلا ما استثني بنص، وبالتالي فإن هذه المرحلة من عمر الصفقة العمومية تعتبر مرحلة حساسة ودقيقة وهامة إذ على أساسها يتحدد مصير مراحل متتالية ومتتابعة من كيفيات وإجراءات إبرام الصفقة العمومية، ورقابتها داخليا، وفقا للتشريع والتنظيم المعمول بهما. Abstract: The granting or refusal of a visa is the legal mechanism that the Algerian regulator has dedicated in favor of Public deals Committee provided for under the provisions of Part One and Chapter Five, entitled Oversight of Public deals, especially the second part of it, which includes organizations for public deals from Presidential Decree 15-247 in order to exercise its supervisory duties within the framework of the external supervisory administrative role entrusted to it, therefore, it is not possible to imagine the conclusion or implementation of a public deal without obtaining a visa, except for what is excluded by a text, and therefore this stage of the path of the public deal is considered a sensitive, accurate and important stage, as on its basis the fate of the public deal is determined Successive and successive stages of the methods and procedures for concluding the public deal, and its internal control, in accordance with the applicable legislation and regulation.
