الاجتهاد المقاصدي بين الضبط والتسيب " حكم الحجاب أنموذجاً" Intentional Diligence Between Regulation And Laxity " Islamic Hijab Provisions As A Case Study". I

الملخص

الاجتهاد المقاصدي هو الاجتهاد الأمثل لمسايرة تسارع المستجدات وتشابكها؛ ما يجعله أحوج إلى الضبط والتحديد؛ للحفاظ على القواعد الشرعية. ويهدف هذا المقال إلى التطرق إلى ضوابط الاجتهاد المقاصدي, وبيان حدود النظر المقاصدي في مسألة فرضية الحجاب. وأهم ما توصلت إليه هذه الورقة البحثية بأن أهم هذه الضوابط هي: الجمع بين ظواهر النصوص ومعاني الألفاظ, مراعاة الصفات الضابطة للمقاصد, مراعاة فقه الموازنات, مراعاة فقه الأولويات, الاجتهاد الجماعي. وفي الأخير تأكد بأن فرضية الحجاب لا تخضع لمتغيرات العصر, ولا يمكن أن يُقال عنها عادة اجتماعية Intentional diligence is the supreme endeavor to keep pace with the acceleration and complexity of developments, Which leads to identifying and maintaining the implementation of the Islamic rules. This article aims to deal with the parameters of diligence regulations within jurisprudence, and also to indicate the limits of intentional consideration of the hijab hypothesis. The main findings of this research paper are that the most important regulations are the combination of textual aspects and semantics, taking into consideration the descriptive qualities of the purposes, parallel jurisprudence, priorities jurisprudence, and collective diligence. Lastly, it is confirmed that the hijab hypothesis does no submit to epochal variables, and cannot usually be considered a social practice.
