التحقيق الجنائي في جرائم الأحداث

الملخص
تعد ظاهرة جنوح الأحداث من الظواهر المستحدثة في المجتمعات خاصة العربية منها ،والتى تستدعي التعامل معها كطاهرة اجتماعية قبل أن تكون قضية جزائية تستوجب توقيع العقاب على مرتبكبها ،فالمشرع الجزائري وكباقي التشريعات الأخرى اعتبر الحدث ضحية حتى وهو مرتكب للأفعال الإجرامية ،لأن الأصل فيه عدم ارتكابة للجريمة وانه ما كان ليرتكبها لولا وقوعه ضحية إما لظروف عائلية أو إقتصادية أو اجتماعية .وعلى هذا الأساس قام بوضع قانون خاص بحماية الطفل رقم 15-12 وهو قانون خاص محصن بالضمانات التى تهدف الى إصلاح الحدث الجانح أكثر من توقيع العقاب عليه ،باعتبار أن الطفل يعتبر عماد المستقبل وبصلاحه يصلح المجتمع ومن ثم توجيهه السليم من أجل عزوفه عن ارتكاب الجريمة مرة أخرى ،فجاءت مجمل نصوص لاسيما المتعلقة باجراءات البحث والتحري في جرائم الاحداث تصب في مصلحة الطفل وهذا ما يدل على أخذ المشرع بالأساليب الحديثة في معاملة الحدث مراعيا في ذلك المصلحة العليا للحدث. كلمات مفتاحية: الحدث ،الحدث الجانح ، إجراءات التحقيق ،قاضي الأحداث Abstract: The phenmenon of juvenile delinquency is one of the new phenomena in societies, especially Arab ones, which calls for dealing with it as a social purity before it becomes a criminal case that requires punishment for its perpetrator. The Algerian legislator, like all other legislation, considers the juvenile a victim even when he is a perpetrator of criminal acts, because the origin is that he did not commit the crime and that he would not have committed it had he not been a victim, either for family, economic or social circumstances. On this basis, he formulated a special law on child protection No. 15-12, which is a special law fortified with guarantees aimed at reforming the delinquent juvenile more than imposing punishment on him, given that the child is considered the mainstay of the future and with his righteousness, he reformes society and then directs him properly in order to refrain from committing the crime once Other texts, especially those related to research and investigation procedures in juvenile crimes, came in the interest of the child, and this indicates that the legislator adopted modern methods of dealing with juveniles, taking into account the higher interest of the juvenile.
