خصوصية بعض الإجراءات المتبعة لمواجهة الجرائم المستحدثة في قانون الإجراءات الجزائية

الملخص
إنتقلت الجريمة من البساطة والعفوية والبعد الوطني، إلى التعقيد والخطورة والبعد الدولي، إذ أصبحت الجرائم ترتكب من طرف أشخاص وعصابات في أكثر من دولة، حت وصلت لدرجة المساس بأمن وإستقرار الدول، هذا ما دفعها إلى تبني إجراءات خاصة مختلفة عن الإجراءات العادية من أجل محاربة هذه الجرائم. تهدف هذه الدراسة إلى البحث في خصوصية بعض الإجراءات التي تبناها المشرع الجزائرى بموجب التعديل الذي مس قانون الإجراءات الجزائية في سنة 2006 و2015، من أجل محاربة الجرائم المستحدثة، نجد من بين هذه الإجراءات التوسيع من صلاحيات الضبطية القضائية، وتمديد آجال الوضع تحت النظر ووضع إجراءات غير عادية في تفتيش المساكن، إلى جانب التوسيع من الإختصاص المحلي لوكلاء الجمهورية وقضاة التحقيق، والتمديد من مدة الحبس المؤقت. The crime has moved from simplicity, spontaneity and the national dimension, to complexity, seriousness and the international dimension, as crimes have become committed by people and gangs in more than one country, even reaching the point of compromising the security and stability of countries, which prompted it to adopt special procedures different from the normal procedures in order to combat these crimes. This study aims to examine the specificity of some of the procedures adopted by the Algerian legislator under the amendment that affected the Code of Criminal Procedure in 2006 and 2015, in order to combat new crimes, we find among these procedures the expansion of the powers of the judicial police, the extension of the deadlines for placement under consideration and the development of extraordinary procedures in the inspection of residences, in addition to the expansion of the local jurisdiction of prosecutors and investigative judges, and the extension of the period of temporary detention. Traditional criminal procedures are no longer sufficient to combat new crimes, which are evolving very rapidly with the technological development that has affected all fields and areas of life, to the extent that these crimes have become a threat to the security of States. The Algerian legislator has introduced procedures distinct from traditional procedures, whether related to preliminary investigation procedures, or related to preliminary investigation procedures to confront new crimes.
