مفهوم الدستور من دساتير الدول إلى دساتير المنظمات الدولية ميثاق الأمم المتحدة نموذجا

- الملخص: صدر ميثاق الأمم المتحدة بإسم الشعوب، نحن شعوب الأمم المتحدة "Nous, peuples des Nations Unies"، وإذا كان مصطلح الدستور ينصرف في معناه العام والمجرد، إلى فكرة السلطة المحدودة والمقيدة، بمعنى آخر الدستور هو آلية للحد من إطلاق السلطة وتوجيهها منهجيا بهدف تنظيما وترشيدها، في أي مجتمع دوليا كان أم وطنيا، ومنه فإن فكرة الدستور وفقا لما سلف ذكره ليست حكرا على الدولة الوطنية، بل تنطبق في جوهرها على أي مجتمع منظم، لذلك حتى وإن اختلفت شكلا فهي تنطبق على النصوص المؤسسة لكيانات فوق وطنية من غير الدول، وفي إطار مختلف هو قانون التنظيم الدولي مما يبرر الاختلافات الشكلية، وفقا للوصف سالف الذكر هل يصدق وصف الدستور في معناه المطلق على المعاهدات المنشئة للمنظمات الدولية أم هو حكرا على كيان هو الدولة الوطنية. الكلمات المفتاحية : ميثاق ؛ صك ؛ معاهدة ؛ منظمات، دساتير Abstract: The "concept of the constitution" has been for many centuries a monopoly on a legal framework that is the framework of the national state, but the developments in international law have led to attempts to transfer the "concept of the constitution" to the law of international organization, hence the beginning of naming the treaties establishing international organizations as the "constitution of the organization." Metaphorically at the beginning, and then in a later development, a jurisprudential trend in international law proposed the idea of constitutionalizing the instruments created for international organizations, and the focus was on the United Nations Charter as a "constitution for the United Nations" and at other times as a "constitution for the international community."
