الملخص

الملخص: يعتبر أسلوب خصخصة المؤسسات العقابية أحد النظم المستحدثة لمواجهة مساوئ العقوبات السالبة للحرية، والتي من أبرزها أزمة تكدس السجون، وما إنجر عنها من إثقال كاهل الخزينة العمومية بأعباء مالية ضخمة، وكذلك ارتفاع نسبة العود للجريمة، بسبب إختلاط السجناء وتكدسهم مع بعضهم، ما جعل المؤسسات العقابية مدارس لإنتاج مجرمين جدد نظرا لفشلها في تطبيق برامج الإصلاح والتأهيل، وقد حاولنا في هذه الدراسة تسليط الضوء على التطور التاريخي لهذا الأسلوب، والجدل الفقهي الذي رافقه من مؤيديين لفكرة خصخصة السجون ومعارضين لها، وكذلك إبراز واقع سياسة خصخصة المؤسسات العقابية في الجزائر. Abstract : The method of privatizing penal institutions is one of the new systems to confront the disadvantages of freedom-depriving penalties, the most prominent of which is the prison overcrowding crisis, and the resulting burden on the public treasury with huge financial burdens, as well as the high rate of recidivism, due to the mixing of prisoners and their overcrowding with each other, which made the penal institutions Schools to produce new criminals due to their failure to implement reform and rehabilitation programmes, and we have tried in this study to shed light on the historical development of this method, and the jurisprudential controversy that accompanied it from supporters and opponents of the idea of privatizing prisons, as well as highlighting the reality of the policy of privatizing penal institutions in Algeria.
