الملخص
يعتبر مبدأ الفصل بين السلطات إحدى أهم الضمانات الدستورية التي تقوم عليها دولة القانون لما يكفله من احترام للحقوق وضمان لممارسة الحريات، ويقصد بهذا المبدأ ضرورة توزيع وظائف الدولة على السلطات العامة فيهاتتولى كل منها وظيفتها بشكل مستقل عن الأخرى، على أن يكون لكل منها رقابة على الأخرى في النطاق الذي يخولها إياه القانون- إعمالا للمقولة الشهيرة " السلطة توقف السلطة"- وعدم حصرها وتركيزها في يد سلطة واحدة على النحو الذي يمكن أن يشكل خطرا على حقوق الأفراد وحرياتهم. Abstract: The principale of séparation of powers is considered one of the most important constitutional guarantees upon which the rule of law is based, as it guarantees respect for rights and guarantees the exercise of freedoms. This principle means the necessity of distributing state functions to the public authorities in them, each of which performs its function independently of the other, provided that each of them has control over The other is within the scope authorized by the law - in implementation of the famous saying “power stops power” - and not confining it and concentrating it in the hands of one authority in a way that could pose a threat to the rights and freedoms of individuals.
