مناهضة الإفلات من العقاب في ضوء أحكام نظام روما الأساسي

الملخص
منذ بداية البشرية حتى الحقبة المعاصرة وتاريخ الإفلات من العقاب تاريخ صراع دائم ومفارقة عجيبة، صراع بين الظالم والمظلوم ، بين المجتمع المدني والدولة ، بين الضمير البشري والهمجية . وفي ظل إستمرار تفشي ظاهرة الإفلات من العقاب جاء النظام الأساسي للمحكمة الجنائية الدولية من خلال نصوصه القانونية لوضع حد لتنصل مرتكبي أشد الجرائم الدولية خطورة من المسؤولية وإفلاتهم من العقاب ،حيث إحتوى على مجموعة من الضمانات التي تكفل فرض العقاب على الجناة وتعزيز المحاسبة ، لتحقيق الهدف النهائي الذي يسعى إليه هذا النظام لإقامة العدالة الدولية الجنائية المنشودة. Abstract Since ancient times until today, the fight against impunity was the subject of an ongoing conflict and paradox; conflict between the oppressor and the oppressed, between civil society and the state, between the human conscience and barbarism. Given the continued expansion of the impunity phenomenon, Rome status of the International Criminal Court, through legal texts, came to stop the perpetrators of serious international crimes and the responsibility of the impunity. This statute contains a set of guarantees to impose the punishment of perpetrators of international crimes and to promote accountability, to achieve the objective of this system and establish the desired international criminal justice. Résumé Depuis la nuit des temps et jusqu'à nos jours, la lutte contre l’impunité faisait l'objet d'un conflit permanent et paradoxal ; conflit entre l'oppresseur et l'opprimé, entre la société civile et l'Etat, entre la conscience humaine et la barbarie. Compte tenu de l’expansion continue du phénomène de l’impunité, le statut de Rome de la Cour pénale internationale, à travers des textes juridiques, est venu pour mettre un terme aux auteurs des plus graves crimes internationaux de la responsabilité et de l'impunité. Ce statut contenait un ensemble de garanties pour imposer la punition des coupables de crimes internationaux et de promouvoir la responsabilisation, Pour atteindre l'objectif de ce système et établir la justice pénale internationale désirée
