حق السجين في الصحة النفسية والعقلية بين متطلبات الحق في الاصلاح وإعادة التأهيل والاندماج في المجتمع

الملخص
إن التبعات النفسية لإيداع الأشخاص السجن غالبا تشكل حجر عثرة أمام نجاح سياسات إعادة التأهيل والإصلاح التي تبنتها الأنظمة العقابية الحديثة، و من جملة ما يجب احقاقه في السجون لتخطي هذه العثرة، حماية حق السجين في الصحة النفسية والعقلية كجزء من الرعاية الصحية العامة التي أقرتها الصكوك الدولية ذات الصلة بحماية حقوق السجناء، خاصة في ظل الاقرار بالتكامل بين الجانبين النفسي و البدني، وباعتبار واقع السجون في مختلف دول العالم يجمع رجال الفقه والقانون على تدني الوضع النفسي لهذه الفئة، خاصة في ظل المشاكل التي تعاني منها السجون، سواء ما تعلق بظروف المسجون، وعدم تقبله للاحتجاز، أو تلك المتعلقة بظروف الاحتجاز، والمشاكل المادية التي تعاني منها السجون، ولاسيما مشكلة الاكتظاظ، بالإضافة إلى وجود بعض الفئات المستضعفة كالنساء والأحداث التي تحتاج الى عناية ورعاية خاصة. The psychological consequences of placing people in prison often constituted a stumbling block to the success of rehabilitation and reform policies adopted by modern penal systems. Among what must be achieved in prisons to overcome this obstacle is the protection of the prisoner’s right to psychological and mental health as part of public health care approved by relevant international legislation related to the protection of the prisoners’ rights. Especially when we know that the relationship between the psychological and physical aspects is a recognized fact. Nevertheless, the reality of prisons in various countries of the world unfolds on a degraded psychological state of prisoners, especially because of the problems that prisons suffer from, some related to the prisoners’ mental conditions and their non-acceptance of detention or other related to the conditions of detention, mainly the problem of the overcrowded prisons. The problem becomes more sensitive in the presence of some vulnerable groups such as women and juveniles who need special attention and care.
