الجهود الدولية والوطنية لحماية الحق في الماء

الملخص
الملخص: أعـلنت الجمعية العامة للأمم المتحدة في هذا السياق،عـن إبرام عـقد دولي من سنة2005 إلى2015 للعمل تحت شعار"الماءمن أجل الحياة"،كآلية لمواجهة تحدي الكوارث المتصلة بالأمن المائي بفعل المخاطر المائية بتنوعها،سواء المتصلة بأنشطة الإنسان التنموية أو اليومية أو حتى طبيعية بيئية أو متصلة بتغيرات المناخ،كلهاعوامل تسببت في ندرة المياه ومعاناة الكثير من الشعوب هي مشاكل عويصة حتمت على المجتمع الدولي وضع برامج تستهدف الحماية للحق في الماء حاضرا ومستقبلا،بِحَثْ الدول كل حسب أنظمته إيجادآليات تكفل الحماية لهذا الحق، لذا فالمنظومة الوطنية سعت بموجب قوانينها وأنظمتها مثل:قانون رقم03/10المتعلق بحماية البيئة في إطارالتنمية المستدامة والقانون رقم05/10المتعلق بالمياه وأنظمة الضبط الإداري الوقائية والعلاجية وكذا نظام التحصيل الجبائي طبقا للمبدأ القائل"الملوث دافع"،وصولاإلى الإدانات الجزائيةمن أجل تفعيل العملية الحمائية للماء وإتسامها بالجدية. الكلمات المفتاحية: الحق في الماء،المخاطر المائية،تغيرالمناخ، المنظومة الوطنية،الوقاية والعلاج ،البرامج الدولية. Abstract: The right to water is considered essential for life, so all international and national organizations were keen to guarantee it, as the United Nations General Assembly declared in this context, On the conclusion of an international contract from 2005 to 2015 to work under the slogan "Water for Life", as a mechanism to confront the challenge of disasters related to water security due to water risks of their diversity, Whether related to human development activities, daily, even natural, environmental or climate change are all factors that have caused water scarcity and the suffering of many peoples, These are formidable problems that necessitated the international community to set up programs aimed at protecting the right to water, now and in the future , Research states, each according to its own regulations, to create mechanisms that guarantee protection for this right. Therefore, the national system has sought according to its laws and regulations, Such as: Law No. 03/10 on the protection of the environment within the framework of sustainable development, Law No. 05/10 on water and preventive and curative administrative control systems, and Likewise, the tax collection system according to the principle that says "polluter pays", up to penal convictions, in order to activate the protective process of water and take it seriously.
