الحماية المؤسساتية للأصناف النباتية الجديدة في ظل قوانين الملكية الفكرية Institutional Protection Of New Plant Varieties Under Intellectual Property Laws

الملخص

تعتبر الملكية الفكرية من بين أبرز المواضيع التي تشغل الرأي العالمي، لما تحدثه من تغيرات في شتى المجالات، حيث تعد الأصناف النباتية الجديدة من بين أهم فروعها، والتي تستوجب الحماية القانونية والمؤسساتية على حد سواء، ولكي تتمتع هذه الأخيرة بالحماية المنشودة وجب أن تتوفر فيها جملة من الشروط الشكلية والموضوعية التي ترتب مجموعة من الحقوق. وعلى هذا الأساس سعى المشرع الجزائري من خلال قوانين حماية الملكية الفكرية إنطلاقا من الإتفاقيات الدولية المتخصصة في هذا المجال إلى توفير حماية شاملة ضد كل إعتداء يطال الأصناف النباتية الجديدة. وقد تضمنت هذه الدراسة تحديدا لهوية الصنف النباتي الجديد محل الحماية وشروط إستحقاقه للحماية القانونية والمؤسساتية، بدءا بالشروط الموضوعية، وصلا إلى خصوصية وذاتية إجراءات إيداعه وطلبه وكيفية فحصه والهيئات المنوطة بذلك من خلال التفصيل المقدم في شقه الشكلي. Intellectual property is among the most prominent topics of concern to world opinion, because of the changes it causes in various fields, where new plant varieties are among its most important branches, which require legal and institutional protection alike. Of the formal and objective conditions that arrange a set of rights. On this basis, the Algerian legislator sought, through intellectual property protection laws, based on international agreements specialized in this field, to provide comprehensive protection against every attack on new plant varieties. This study included exactly the identification of the new plant variety subject to protection and the conditions for its entitlement to legal and institutional protection, starting with the objective conditions, reaching the specificity and subjectivity of its deposit and application procedures, how to examine it, and the bodies entrusted with this through the detail provided in its formal apartment.
