ملخص: في إطار ديناميكية التشريع الجزائري وسعيه الحثيث إلى إيجاد الحلول والأدوات الناجعة لمجابهة ظاهرة الفساد الآخذة في الانتشار والتمدد، سعى وبالذات ضمن دستور الفاتح نوفمبر 2020 إلى الارتقاء بأدوات الوقاية من الفساد ومكافحته إلى مصف أن تتعدى ما كان سابقا في صورة الهيئة الوطنية للوقاية من الفساد ومكافحته كمؤسسة استشارية، لأن تكون ضمن المادة: 204 من الدستور في شكل سلطة عليا للشفافية والوقاية من الفساد ومكافحته ضمن باب المؤسسات الرقابية، إتاحة للحركة والفعل في مجابهة الفساد ليتوج ذلك بصدور القانون رقم: 22-08 المؤرخ في: 05 مايو 2022 المحدد لتنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته وتشكيلها وصلاحياتها. لذلك يأتي هذا المقال للنظـــر في مدى التغيير والجدوى من هيئة وطنية للوقاية من الفساد ومكافحته إلى سلطة عليا للشفافية والوقاية من الفساد ومكافحته. الكلمات المفتاحية: السلطة العليا للشفافية والوقاية من الفساد ومكافحته، الهيئة الوطنية للوقاية من الفساد ومكافحته، دستور الفاتح نوفمير 2020، النجاعة والجدوى، القانون 22-08. Summary: In the context of the dynamism of Algerian legislation and its relentless quest to find effective solutions and tools to confrontthe widespread and expanding phenomenon of corruption. It sought, particularly, within the Constitution of November 1st, 2020, to upgrade the tools for preventing and fighting against corruption to a level that exceeds what was previously in a form of the National Authority for the Prevention and Fightingagainst Corruption as an advisory institution, to be within article 204 of the Constitution in the form of a Supreme Authority for Transparency, Prevention and Fighting against Corruption within the control institutions section.In order to allow movement and action in the face of corruption, it is culminated by the issuance of law No. 22-08 of May 05th, 2022 specifying the organization, the formation and the powers of the supreme authority for transparency, prevention and fightingagainst corruption. Therefore, this article comes to consider the extent and efficiency of change from a national authority to prevent and fight against corruption to a supreme authority for transparency and prevention and fighting against corruption.
