الملخص

إثر إطلاق شبكة الأنترنت على المستوى العالمي، أصبح تداول المعلومات والمعرفة سهلا ومتوافرا لمستخدمي الشبكة نتيجة اتصال الحواسيب عبر العالم ببعضها البعض، كما أدى ذلك الى تطور مختلف المجالات العلمية، الاقتصادية، التجارية وغيرها عن طريق استعمال أسماء النطاق التي تسمح للمتعاملين لاسيما التجار عرض سلعهم وخدماتهم من أجل التعريف بها والترويج لها. الا ان هذه التعاملات قد صادفت العديد من المخاطر لاسيما الاعتداء على أسماء النطاق لما لها من قيمة وشهرة لدى الجمهور المعني بها. هذا ماحدىبالمنظمة العالمية للملكية الفكرية الويبو تبني العديد من الإجراءات البديلة عن القضاء من أجل فض المنازعات المتعلقة بأسماء النطاق عن طريق السياسة الموحدة لحل النزاعات UDRP. Following the launch of the Internet at the global level, the information and knowledge exchange became easy and available to users over the network as a result of the connection of computers across the world to each other, and this also led to the development of various scientific, economic, commercial and other fields of execution through the use of domain names that allows dealers, especially merchants Display their goods and services in order to introduce and promote them. However, these transactions have encountered many risks, especially cybersquatting on domain names regarding to their value and popularity with the public. This is what prompted the World Intellectual Property Organization (WIPO) to adopt several alternative judicial procedures for resolving disputes related to domain names through the Uniform Dispute Resolution Policy (UDRP).
