الجريمة المنظمة عبر الوطنية (جريمة الاتجار بالأشخاص نموذجا)

الملخص
الملخص: تعتبر جريمة الاتجار بالأشخاص صورة من صور الجريمة المنظمة عبر الوطنية، كما لها علاقة بجريمة تهريب المهاجرين، وذلك أن أغلب الأشخاص الذين يتم تهريبهم ينتهي بهم الأمر إلى أن يكونوا محلاً للاتجار. ومنه، فإن هذه الجريمة تصنف من بين الجرائم الخطيرة لأنها تشكل تعد صارخ على كرامة الإنسان وحقوقه، وتعد صورة من صور الاسترقاق والعبودية في شكله المعاصر. ولقد تزايدت هذه الجريمة بشكل كبير في الوقت الحالي بالنظر لعائداتها الربحية الكبيرة على المنظمات الإجرامية، وكذلك بالنظر لتعدد أسبابها ومساعدة الظروف في انتشارها، وهذا الأمر هو الذي دفع الدولة الجزائرية إلى التدخل وقيامها بعدة مجهودات من أجل مكافحتها والمتمثلة في مصادقتها على اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية وعلى البروتوكولين المكملين لها ألا وهما بروتوكول منع وقمع ومعاقبة الاتجار بالأشخاص وبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو. Summary: The crime of human trafficking is considered a form of transnational organized crime, as it is related to the crime of smuggling migrants, because most of the people who are smuggled end up being trafficked. Hence, this crime is classified among the serious crimes because it constitutes a flagrant violation of human dignity and rights, and is a form of slavery and servitude in its contemporary form. This crime has increased dramatically at the present time through its large profit returns on criminal organizations, as well as through of the multiplicity of its causes and the assistance conditions in its spread, and this is what prompted the Algerian state to intervene and make several efforts to combat it, represented in its ratification of the United Nations Convention against Crime The Transnational Organization and the two complementary protocols, namely, the Protocol to Prevent, Suppress and Punish human Trafficking and the Protocol against the Smuggling of Migrants by Land, Sea and Air.
