أثــر العفــــو الشامل على الدعــــوى التأديــبيــة في التشريع الجزائري

الملخص
ملخص: في التشريع الجزائري، منذ نشأته، لم يكن للعفو عموما والعفو الشامل أي أثر على المجال التأديبي، إلا بعد إعلان ميثاق السلم والمصالحة الوطنية، الذي جاء لإنهاء المأساة الوطنية، وإنقاذ ما أمكن من ضحاياها. حيث نص الميثاق والقوانين التنظيمية التي تبعته على إقرار تأثير العفو الشامل وبيان كيفيات تطبيقه على المسؤولية التأديبية بصورة غير مسبوقة. ونتيجة حركية ومرونة التقنين والتنظيم التي هي من أبرز سيمات التشريع الجزائري، امتد مجـــــال تأثير العفو الشامل إلى المجال التأديبي، دون أن يُترك على إطلاقه. حيث حدد المشرع أثر العفو الشامل على المسؤولية التأديبية التي تقوم بالتبعية للمسؤولية الجزائية دون غيرها. وفي هذا تكريس لمبدئين في القانون: - دستورية القوانين. استقلالية كل من الدعوى العمومية والدعوى التأديبية.. Abstract: The amnesty in general and the blanket amnesty in the Algerian legislation since its inception had no effect on the disciplinary field, except after the declaration of the Charter for Peace and National Reconciliation, which came to end the national tragedy and save as many victims as possible. Where the charter and the regulatory laws that followed it stipulate the acknowledgment of the impact of a blanket amnesty and the modalities of its application on disciplinary liability in an unprecedented manner. As a result of the dynamism and flexibility of legalization and regulation, which is one of the most prominent features of Algerian legislation, the impact of the blanket amnesty extended to the disciplinary sphere without being left limitless and where the legislator determined the impact of a blanket amnesty on disciplinary liability, which is subordinate to criminal liability alone. In this, two principles of law are devoted: - The constitutionality of laws. - The independence of both the public and disciplinary lawsuit.
