دور المحكمة الإفريقية لحقوق الإنسان والشعوب في حماية حقوق الشعوب الأصلية

الملخص
تعتبر مسألة تعزيز وحماية حقوق الشعوب الأصلية في إفريقيا، من بين أهم المسائل التي تحتاج إلى دراسة وتحليل نظرا لكونها من المجتمعات الإنسانية المتميزة، والتي تحمل خصائص اجتماعية وثقافية واقتصادية وسياسية تميزها عن غيرها من الشعوب، سعت على أساسها إلى كسب الاعتراف بهوياتها وأسلوب حياتها وحقها في الأراضي والأقاليم والموارد الطبيعية لسنوات، ولكن حقوقها تنتهك دائمًا من قبل الحكومات الوطنية رغم الحماية القانونية التي توفرها الدساتير الوطنية والصكوك الدولية والإقليمية المعنية بحقوق الإنسان. مما دفع بهذه الفئة إلى اللجوء إلى القضاء للانتصاف والمطالبة بالتعويض. عالجت المحكمة الإفريقية لحقوق الإنسان والشعوب، باعتبارها الهيئة القضائية الإقليمية الرئيسية التابعة للاتحاد الإفريقي، قضية تاريخية تتعلق بشعب الأوجيك ضد كينيا. بموجب قرارها الشهير، ستتمكن بقية الشعوب الأصلية في إفريقيا من التقاضي بشأن انتهاكات حقوقها المعترف بها بموجب الميثاق الإفريقي لحقوق الإنسان والشعوب. The promotion and protection of the rights of indigenous peoples in Africa is one of the most important issues that require study and analysis.These communities, despite their distinguishingsocial, cultural, economic and political characteristics, have sought recognition of their identities, their way of life and their right to lands, territories and natural resources for years, but their rights are still violated by national governments despite the legal protection provided by national constitutions and international and regional human rights instruments. This has prompted this category to seek redress and compensation through the courts. The African Court on Human and Peoples' Rights, as the principal regional judicial organ of the African Union, has dealt with a landmark case involving the Ogiekpeople against the Kenyan Government. By virtue of its landmark decision, the rest of Africa's indigenous peoples will be able to pursue legal action for violations of their rights under the African Charter on Human and Peoples' Right
