الملخص
ملخص: أفرزت السنوات الأخيرة من القرن العشرين وبداية القرن الواحد والعشرين ثورة من نوع آخر متعلقة بوسائل الاتصال والمعلومات لعل من أهمها ظهور أجهزة الحاسب الآلي والهواتف النقالة ذات المستوى العالي، وهذا التطور أدى إلى استحداث شبكات ونظم المعلومات حتى بات يطلق عليها النظام المعلوماتي، بظهور الانترنت كوسيلة مثلى في الاتصالات ونقل المعلومات وتقديمها فهذه التقنيات كان لها الأثر الإيجابي على حياة الفرد والمجتمع، من تقدم تكنولوجي وتقني هائل وظهور الفضاء الإلكتروني ووسائل الاتصالات الحديثة كالانترنت الهاتف الذكي، الفاكس، انتشار مواقع الاتصال الاجتماعي كالفايسبوك المسانجر ،الوات ساب، تيلغرام... وغيرها من صور الاتصال الإلكتروني عبر الأقمار الصناعية. ولكن بالرغم من هذه المزايا الهائلة التي تحققت وتتحقق كل يوم بفضل تقنية المعلومات على جميع الأصعدة وفي شتى مجالات الحياة، فإن هذه الثورة التكنولوجية المتنامية صاحبها في المقابل جملة من الانعكاسات السلبية الخطيرة جراء استخدام هذه التقنية المتطورة والانحراف عن الغرض المرجو منها أدى إلى تفشي ظواهر إجرامية كالجريمة المعلوماتية أو الإلكترونية، والذي استغله مرتكبو الجرائم الإلكترونية في تنفيذ جرائمهم التي لم تبقى داخل حدود المحيط بل وصلت لحدود الدول وأصبحت جرائم عالمية جرائم مبتكرة ومستحدثة تمثل ضربا من ضروب الذكاء الإجرامي،وهي جرائم انتشرت في الجزائر وأصبحت تعاني منها كباقي الدول الأخرى، خاصة على مستوى الملاحقة الجنائية في ظل القوانين الوطنية أو على صعيد القوانين الدولية. وتعتبر الجريمة الإلكترونية موضوعا واسعا فهي ظاهرة إجرامية تعاني منها المجتمعات في الآونة الأخيرة من انتهاك للحقوق والخصوصيات الإلكترونية، حيث تعددت وجهات النظر بخصوص هذا النوع المستجد من الجرائم سواء في التشريع الدولي أو في التشريع الجزائري، ولهذا هدفت الدراسة لإبراز جوانب الجريمة الإلكترونية من مفهومها وأنواعها وموضوعها وخصائصها وطبيعتها المتميزة التي تنفرد بها هذه الجريمة عن غيرها من الجرائم وكذلك تبيان الصفات التي يتمتع بها المجرم الإلكتروني كمبحث أول، أما المبحث الثاني فجاء لتوضيح موقف المشرع الجزائري من الجريمة الإلكترونية وكذلك إبراز أهم التحديات التي تواجه الجريمة الإلكترونية وكيفية رصدها وأهم الحلول التي يمكن طرحه من أجل محاربة ومواجهة هذه الظاهرة.Abstract: Enter your abstract here (an abstract is a brief, The last years of the twenyieth century and the beginning of the twenty-first century produced a revolution of another kind related to the means of communication and iformation, perhaps the most important of which was the emergence of computers and high-level mobile phones, and this development led to the development of networks and information systems until it became called the information system, with the emergence of the Internet as an ideal means, information trasfer and presentation, these technologies have had a positive impact on the life of the individual and society, from tremendous technological and technical progress and the emergence of cyberspace and modern means of communication such as the Internet, smartphone, fax, the spread of social communication sites such as Facebook, Messenger, WhatsApp, Telegram…and others satellite imagery. But despite these enormous advantages that have been achieved and are beig realized every day thanks to information technology at all levels and in various fields of life, this growing technological revolution was accompanied by a number of serious negative repercussions as a result of the use of this advanced technology and deviation from its intended purpose, which criminal phenomena. Such as information or electronic crime, which the perpetrators of cybercimes exploited to carry out their crimes that did not remain within the borders of the ocean, but rather reached the borders of countries and became global crimes the level of criminal prosecution under national laws or at the level of international laws. Cybercrime is considered a broad topic, as it is a criminal phenomenon that societies suffer from in recent times in violation of electronic rights and privacy, as there are many points of view regarding this emerging type of crime, whether in international legislation or in Algerian legislation, and for this reason the study aimed to highlight aspects of cybercrime in terms of it concept, types and topic and its characteristics and distinct nature that distinguishes this crime from other crimes, as well as clarifying the characteristics that the electronic criminal enjoys as a first topic order to fight and counter these phenomenon
