مدى مراعاة تشريعات الإفلاس للجوانب الإنسانية

الملخص
يعد الإفلاس واقعة ذات آثار ونتائج متعددة، وأخطر تلك الآثار والنتائج تصفية أصول التفليسة، وغل يد المدين، ومنعه من القيام بالعديد من الأعمال والتصرفات. وقد هدفت هذه الدراسة إلى إيضاح مدى مراعاة تشريعات الإفلاس للجوانب الإنسانية. ومن أهم النتائج التي توصلت إليها الدراسة أن تشريعات الإفلاس أقرت حماية قانونية لأموال المفلس اللصيقة بشخصه ومهنته، وراعت ما يحفظ على المدين كرامته ومكانته وإنسانيته. كما أعطت أولوية لديون النفقة والعمال، وقدمتها على غيرها من الديون؛ حماية ورعاية لأصحابها. Abstract: Bankruptcy is an occurrence with multiple effects and results, and the most serious of these effects and results are the liquidation of the bankruptcy assets, incapacitation of the debtor and preventing him from carrying out many performances and actions. This study aimed to clarify the extent to which bankruptcy legislation takes into account the humanitarian aspects. Among the most important findings of the study is that bankruptcy legislation approved legal protection for the bankrupt's money attached to his person and profession, and took into account what preserves the debtor's dignity, status and humanity. It also gave precedence to alimony and labor debts, and gave them priority over other debts; to serve as protect and care for their owners. Keywords: Humanity; Bankruptcy; Debtor; Alimony; Laborers.
