أثر العرف على حقوق الزوجة المالية

الملخص
للعرف دور بالغ الأهمية في حياة الناس، وهذا راجع لأثره الواضح في الأحكام الفقهية والقانونية التي تحكم تصرفاتهم، حيث أحيل كثير منها إلى العرف وكان للعرف فيها اعتبار، حيث أنه في مجال الأحوال الشخصية أرسى العرف أحكامه وقواعده على غرار باقي المجالات، ومن بين المواضيع المهمة في الأحوال الشخصية التي ستصب فيها دراستنا الحقوق المالية للزوجة، التي يلاحظ التأثير الكبير للعرف على عدة مسائل متعلقة بالجانب المالي لحقوق الزوجة. وباعتبار أن المهر من أهم حقوق الزوجة على زوجها وراجع هذا لاعتبارات شرعية وقانونية فهو شرط ضروري لصحة الزواج فقد تأثر الصداق في مسائل عديدة منه - كتقديره ومسألة تعجيله وتأجيله، الاختلاف في قبض المهر، وصداق المثل – بالعرف السائد في المجتمع. كذلك للعرف أثر على النفقة كحق من حقوق الزوجة المالية، فالنفقة المقررة للزوجة سواء كانت نفقة طعام أو كسوة أو حتى نفقة علاج، جميعها للعرف فيها تأثير، أما بالنسبة للسكن من مشمولات النفقة باعتباره حق من حقوق الزوجة، إذ على الزوج توفير السكن المناسب لزوجته وتهيئته بما يليق بها فالعرف له تأثيره على هذا الحق من حيث التباين في حال الزوج، ونلمس تأثير العرف في كل هذه المسائل من خلال الشواهد والأمثلة الموجودة في حياتنا اليومية. Abstract: Convention has a very important role in human life, and this due to its clear impact on the doctrinal and law regulations, which govern their behaviors, as many of the latter have been referred to convention which were considered in them, since convention has set its regulations and rules in the field of personal status, on the lines of the other fields. Wife’s Financial Rights is one of the major issues in personal status, on which our study will focus, since it is observed in it the important impact of convention on several issues related to the financial aspect of wife’s rights. Considering that dowry (Mahr) is one of the major rights of wife, over her husband, and this is due to doctrinal and legal considerations, and it is a necessary condition for the marriage validation; the dowry has has been affected by the convention of society in many issue-such as appreciation and the issue of accelerating and postponing it, the differences in receiving the dowry and peer's dowry. As well as, convention has an impact on alimony, as one of wife’s financial rights, because the fixed alimony of the wife, whether it is food, clothing or healthcare expenses, is affected by convention. As for housing, it is among the alimony expenses, as one of wife’s rights, since the husband must provide an appropriate house for his wife and equipping it to suit her; convention has an impact on this right in terms of the differences in husbands’ situations, and we can stand on the impact of convention in all these issues, through the existing evidence and examples in our daily life.
