تجسيد الأنبياء والصّحابة في النَّظر الفقهيِّ المعاصر- دراسة فقهيَّة أصوليَّة - The Depiction Of Prophets And Companions According To Contemporary Islamic Jurisprudence

الملخص

إنَّ ممّا يهدف إليه بحثي تلخيص مذاهب الفقهاء المعاصرين في مسألة تجسيد الأنبياء والصّحابة، والكشف عن الأصول التي بنوا عليها أحكامَهم في هاتين المسألتين. وقد خلصتُ في ختام بحثي إلى أنَّ الفقهاء المعاصرين اتّفقوا على تحريم تجسيد الأنبياء عليهم الصّلاة والسّلام في الأعمال الفنيَّة، ومستندُهم في هذا الاتّفاق هو سدُّ الذّرائع، وأمَّا بالنّسبة لتجسيد الصّحابة رضي الله عنهم في الأعمال الفنيَّة المختلفة فقد اختلفوا بين مبيحٍ له بقيود، وبين مانع منه، فعمدةُ المجّوزين لتجسيد الصّحابة رضي الله عنهم هو المصلحة المرسلة، ومعتمدُ المانعين من تجسيد الصّحابة رضي الله عنهم في الأعمال الفنيَّة هو سدُّ الذّريعة إلى التّنّقص من قدر الصّحابة، وإضعاف هيبتهم ومكانتهم في النّفوس. The objective of my research is to summarize the opinions of contemporary jurists regarding the depiction of prophets and companions. It also aims to uncover the principles of jurisprudence that have been used to issue rulings on these two issues. At the conclusion of my research, I found that contemporary jurists are unanimous on the prohibition of the depiction of Prophets, peace be upon them. Their reference in this matter is preventing the excuse for engaging in a prohibited act, as for the depiction of companions, may Allah be pleased with them, there is a difference of opinion, with some permitting it within certain limits and others prohibiting it entirely. The reference for those who permit it is that it serves the general interest, while the reference for those who forbid it is the blockage of the excuse to undermine the status of the companions, as well as diminishing their reputation and status from within their followers.
