آراء الفقهاء في عَاقِبَة القانون الدولي

الملخص
ملخص: إن فلسفة علم السياسة التشريعية تقتضي الدقة والإيجاز، وما كتبه أوبنهايم وجمَعه في كتابه "مستقبل القانون الدولي" سابقة لم يسبق من قبله أحدٌ إليها، على أن هذا التحول من القانون الجنائي إلى القانون الدولي في حياة أوبنهايم غير معروف الدوافع، إلا أنه كسب شهرة طغت على مَن قبله ومَن بعده؛ ومما لا شك بعد هذا تأثر الفقهاء العرب في أعمالهم به، وكان هذا الكتاب يحمل بين طيَّاته آراء لاسا أوبنهايم حول التنظيم الدولي في شكل دولة عالمية، وبيانًا لأهمية السلام، ولعله أجاد وأحسن عندما تحدث عن التشريع الدولي وصعوباته، وكذلك الأمر في فكرة إنشاء محكمة العدل الدولية في زمان كانت فيه مثل هذه الأفكار تعد من الخيال العلمي؛ بل سخافة، إلا أنه لم ييأس، وردَّ على المعارضين وحاجَجهم، فوصلنا إلى قناعة أنه لو مُدَّ له في سني حياته لـمَا غيَّر أو تراجع عما كتبه. Abstract: The philosophy of Legislative Politics demands a man to have an accuracy and conciseness. Actually, what Oppenheim wrote and collected in his book “The Future of International Law” is considered to be a precedent, for there is no one who has preceded him before in tackling this subject. Although the reason behind this shift from Criminal Law to International Law in Oppenheim’s life is unknown, it made him to be widely known; There is no doubt that the Arab jurists’ works were influenced by him.. In addition, this book contains Oppenheim's personal perceptions about the International Legislation in a form of a global state and a declaration of the significance of peace. In my opinion, he was excellent in discussing the idea of international legislation and its difficulties and also the idea of establishing the International Court of Justice at a time when such ideas were considered nothing but a science fiction and an absurd! But he did not despair and confuted his opponents and argued them. So, we come up with a conviction that if he had live longer, he would neither edit nor change his mind about what he wrote.
