الاختيار الفقهي- دراسة تأصيلية-

الملخص
لقد أنتج الفقهاء الأوائل تراثا زاخرا من الأقوال الفقهية، ممّا عبّر عن رحابة الشريعة بما يسّرته على الناس من أمور دينهم ودنياهم، إلا أنّ ذلك استدعى من الفقيه الذي يريد أن يكون له رأيا في مسألة خلافية ما عَرْضَ تلك الأقوال على بساط النقد والتمحيص؛ بغية الوصول إلى قول يختاره لنفسه ويفتي به غيره ممّن لم يبلغ درجته، وحتى لا يجعل المكلَّف يحتار لا يعرف أيّ الأقوال يعتمد. إنّ قصد الفقيه القائم بالاختيار إلى القول المختار دون ما سواه إنّما يكون بعد تفكّر ونظر، وعن دليل انقدح في الذهن استنادا إليه رجّح الفقيه واختار؛ لأنّ الاختيار نوع اجتهاد، وحكمه حكم الاجتهاد، ومجاله مجال الاجتهاد، كما أن عملية الاختيار الفقهي عملية دقيقة مضبوطة بضوابط معيّنة؛ لذلك فهي لا تتأتّى إلاّ من قِبل من امتلك القدرة على ذلك، فأحاط بأقوال المذهب ضعفيها وقوّيها، وعرف أدلة الأحكام وطرق الاستنباط، وردّ الفروع إلى أصولها وما إلى ذلك. Abstract: The early jurists produced a supernatural legacy of fiqh, which expressed the spaciousness of the shria, which pleased people on matters of religion and their world, however, this was called from the jurist who wants to have a say in the issue of disagreement, the presentation of words on the surface of criticism and scrutiny in order to reach a statement of his choice for himself and other people who did not reach the grade of , so as not to make the taxpayer does not know which statement is adopted the intention of the jurist to choose the chosen word without any other is after thinking and looking, and the evidence in the mind based on which the faqih is likely and chose because choice type diligence, and his ruling is ijtihad, and the field of ijtihad. The process of choice of jurisprudence is a precise process set by certain controls ,therefore, it can only come from those who have the ability to do so, the doctrine is weak and strong, he knew the evidence of the judgments and the methods of reasoning branches responded to their origins and so on, therefore, the choice is only from his family, it is not permissible for imitators to have no argument with him.
