التكييف الفقهي للنوازل المعاصرة _ضوابط وتطبيقات_

الملخص
يحاول هذا البحث الكشف عن إحدى الأدوات المهمة في التعامل مع النوازل عموما والنوازل المعاصرة خصوصا، ومن أهم هذه الأدوات عملية التكييف الفقهي للنوازل، حيث تم توجيه النظر إلى مفهومه وبعض المفاهيم القريبة منه، وأهميته خصوصا لمن يتصدى ويتصدر للإفتاء ومعالجة قضايا المسلمين أفرادا وجماعات، ثم بيان أهم أصوله وضوابطه التي ينبغي التحاكم إليها في إعماله أثناء تطبيقه على النوازل والمستجدات المعاصرة، وأخيرا إيراد بعض التطبيقات والنماذج من النوازل المعاصرة مع بيان وجه إعمال آلية التكييف الفقهي. فكان مما خلص إليه البحث دور التكييف الفقهي والحاجة الماسة إليه في النوازل المعاصرة نظرا لاعتبارات متعددة من بينها تعقد الحياة وتطورها بشكل سريع، إلا أن إعمال التكييف الفقهي يلزم منه الانطلاق من أصوله ثم الالتزام بضوابطه حماية لجناب الشريعة وتحقيقا لمقصود الشرع من وضع هذه الشريعة ثم تحقيقا لمصالح العباد في الدنيا والآخرة. Abstract: This research attempts to uncover one of the important tools in dealing with the comings in general and contemporary ones in particular, the most important of which is the process of doctrinal adaptation of the coming down, where the consideration of its concept and some concepts close to it, and its importance e, especially for those who address and lead the fatwa and address the issues of the dedescendant'sndividuals and groups, and then to indicate its most important origins and controls that should be tried in its implementation during its application to the houses and contemporary developments, and finally the inclusion of some applications and models of contemporary houses with a statement of the face of the realization of the mechanism of Doctrinal adaptation. The research concluded that the role of doctrinal adaptation and the urgent need for it in contemporary situations due to various considerations, including the complexity of life and its rapid development, but the realization of the doctrinal adaptation requires it to start from its origins and then abide by its controls to protect the sides of sharia and to achieve the purposes of Sharia from establishing this sharia and then to achieve the interests of the servants in this world and the hereafter.
