حماية اللاجئين في إطار القانون الدولي الإنساني

الملخص
تعد مشكلة اللاجئين من المشاكل الأكثر تعقيداً على مستوى المجتمع الدولي، فقد ساهم الأخير في وضع منظومة قانونية لحماية اللاجئين وإيجاد الحلول الدائمة والمناسبة لهم من خلال اقرار اتفاقية جنيف الخاصة بوضع اللاجئين لعام 1951 والبروتوكول الملحق بها لعام 1967، أيضاً تناول واضعوا القانون الدولي الإنساني في اتفاقيات جنيف لعام 1949 حماية خاصة للاجئين جراء النزاعات المسلحة أو الاحتلال من طرف دولة لدولة الأمر الذي ساعد المجتمع الدولي في تسهيل اختصاص كل من القانون الدولي الإنساني والقانون الدولي للاجئين وذلك في النظر في وضعية كل لاجئ حسب مكان وجوده سواء عبر الحدود الدولية أو ظل في الأراضي المحتلة وخضع لقواعد القانون الدولي الإنساني. The refugee problem is one of the most complex problems at the level of the international community, as the latter contributed to setting up a legal system for the protection of refugees and finding durable and appropriate solutions for them through the adoption of the Geneva Convention Relating to the Status of Refugees of 1951 and the Protocol attached thereto of 1967, also dealt with the drafters of international humanitarian law in conventions Geneva of 1949, special protection for refugees due to armed conflict or occupation by state to state, which helped the international community in facilitating the jurisdiction of both international humanitarian law and international refugee law in considering the situation of each refugee according to his whereabouts, whether across international borders or he remained in the occupied territories And subject to the rules of international humanitarian law Le problème des réfugiés est l'un des problèmes les plus complexes au niveau de la communauté internationale, car celle-ci a contribué à mettre en place un système juridique de protection des réfugiés et à leur trouver des solutions durables et appropriées à travers l'adoption de la Convention de Genève relative à la le statut des réfugiés de 1951 et le protocole y annexé de 1967, ont également traité des rédacteurs du droit international humanitaire dans les conventions de Genève de 1949, protection spéciale des réfugiés en raison d'un conflit armé ou d'une occupation d'État à État, ce qui a aidé la communauté internationale à faciliter la compétence du droit international humanitaire et du droit international des réfugiés en examinant la situation de chaque réfugié en fonction de son lieu de séjour, qu'il ait franchi les frontières internationales ou qu'il soit resté dans les territoires occupés et sous réserve des règles du droit international humanitaire
