ملخص: كانت الشهادة ولا تزال من أهم وسائل الاثبات، تكمن أهميتها في أنها يعتمد عليها القضاة في اصدار أحكامهم القضائية، فالإثبات بشهادة الشهود يخضع للسلطة التقديرية للقاضي، حيث يقوم بتقدير قوال الشهود واستخلاص الواقع منها، ولا يخضع في ذلك الى رقابة المحكمة العليا Abstract: This study aims to shed light on the most important statements made by the successive Algerian Constitutions in the field of rights and public freedoms, which deal with each of them under the socialist system, also under the liberal system and the conclusion that there is progress or regression in achieving constitutional justice in Algeria
