جرائم المساس بالأديان السماوية والمُواجهة الجنائية بين حُرية الإعتقاد وحُرية التعبير

الملخص
ملخص تناولت الدراسة صوراً من جرائم المساس بالأديان، في حين تعلل السلطات فى بعض الدول وخاصة الأوروبية بعدم إمكانية مساءَلة مُرتكبيها بحُجة أن ذلك يأتي في إطار حُرية التعبير، ولذلك حاولت توضيح الخيط الفاصل بين حُرية الاعتقاد وممُارسة شعائر العقيدة من جهة وحرية التعبير من جهة أخرى، واستنجت أن ذلك من أعقد الإشكاليات التي تواجهها حماية الأديان السماوية، بجانب تعدد مكاييل الدول الغربية في هذا الشأن، وقصوراً في تجريم بعض صور المساس بالأديان. فأوصيت بأن يقوم المشرع المصري بإضافة "جريمة المنع بالإكراه من ممارسة الشعائر الدينية " ضمن الجرائم الماسة بالأديان ، وأن يتم العمل على عقد اتفاقية دولية خاصة بحماية الأديان السماوية بما بضمن حرية الاعتقاد ولا يَجُور على حرية التعبير المُعتدلة. الكلمات المفتاحية: الأديان، الجريمة، السماوية، الاعتقاد، التعبير. Summary The study dealt with images of crimes against religions, while the authorities in some countries, especially European ones, explain the impossibility of holding perpetrators accountable on the pretext that this comes within the framework of freedom of expression. Therefore, it tried to clarify the line between freedom of belief and the practice of religious rites on the one hand, and freedom of expression on the other, and concluded This is one of the most complex problems faced by the protection of the revealed religions, in addition to the multiplicity of standards of Western countries in this regard, and the shortcomings in criminalizing some forms of prejudice to religions. I recommended that the Egyptian legislator add the “crime of forcibly preventing the practice of religious rites” among the crimes against religion, and that work be done on concluding an international agreement to protect the revealed religions in a manner that guarantees freedom of belief and does not infringe on moderate freedom of expression.
