أشكال جرائم المساس بالتراث الثقافي

الملخص
تعد الجرائم الواقعة على التراث الثقافي من أخطر الجرائم التي تهدد الأمن والسلم الدوليين، بإعتبارهاإعتداء على الثقافة الوطنية وتغيير للهوية الحضارية، لتشمل مظاهرها عدة جرائم من أهمها البيع والإخفاء التشويه والإتلاف الحيازة غير المشروعة للممتلكات الثقافية هذه الأخيرة التي تؤدي الى تزييف وتحريف التاريخ، وغير ذلك من الجرائم والإعتداءات الواقعة عليها لذلك كان لزاما إحاطتها بالحماية القانونية من خلال تجريم هذه الجرائم المختلفة سواء على المستوى الوطني أو الدولي ولدراسة هذه الجريمة لابد من الوقوف على مفهومها بتعدد الزوايا التي تعالجها، وبيان صورها ومظاهرها التي تميزها وتفرقها عن غيرها من الجرائم، ودراسة إجراءات مكافحة الجرائم والجهود المبذولة لمواجهتها. هذه الظاهرة الإجرامية التي تستهدف الهوية الثقافية للمجتمعات البشرية، وتؤدي الى انقطاع الشعوب عن ماضيها التاريخي والحضاري، وتساهم في تحقيق الغزو الثقافي والفكري من هنا تظهر مدى خطورتها الإجرامية وهو ما أضحى يتطلب تضافر الجهود الدولية في مكافحة هذه الجرائم وكل أشكال المساس بالتراث الثقافي. Crimes against cultural heritage are among the most serious crimes that threaten international peace and security, as an attack on national culture and a change in cultural identity, including several crimes, including selling, concealing, distorting and destroying the illegal possession of cultural property. The latter that leads to the falsification and distortion of history, and other crimes and assaults on them, therefore it was necessary to be surrounded by legal protection by criminalizing these various crimes, whether at the national or international level, and to study this crime must be seen as a multiplicity of angles that It addresses them, shows their images and manifestations that distinguish them from other crimes, and examine sought action against crimes and efforts to counter them. This criminal phenomenon, which targets the cultural identity of human societies, leads to the interruption of peoples from their historical and cultural past, and contributes to the cultural and intellectual invasion from here, shows how serious they are, which now requires concerted international efforts in combating these crimes and all forms of crime.
