المسؤولية الجنائية للخطأ الغير عمدي في ظل فيروس كورونا المستجد Covid19

الملخص
تعتبر المسؤولية الجزائية من أهم النظريات في قانون العقوبات، حيث نصت عليها عدة مواد من هذا القانون، سواء ما تعلق بموانع المسؤولية الجزائية أو بشروطها . نعالج في هذا المقال مسؤولية الخطأ الغير عمدي أو ما يصطلح عليه بالجرائم الغير عمدية في ظل جائحة كورونا Covid-19. وترجع أهمية ذلك إلى ازدياد الجرائم الغير عمدية وانتشارها في هذه الفترة بسبب تهاون المواطنين واستهتارهم بخطورة هذا الوباء، وعدم احترامهم للقوانين والأوامر والأنظمة المقررة للحجر الصحي. مما جعلنا نحاول تسليط الضوء على ماهية المسؤولية الجنائية للجرائم الغير العمدية المرتكبة، وطبيعة هذه الجرائم ومدى ارتباطها بفيروس كورونا المستجد Covid-19 Abstract Criminal responsibility is one of the most important theories in the penal code, as it is stipulated in several articles of this law, wether it is related to the impediments to criminal responsibility or its conditions. The present article medicates the responsibility of the non-intentional error or what is termed the unintentional crimes under the current circumstances of COVID-19 pandemic. The importance of the study is due to the increase in unintentional crimes and their proliferation in this period because of citizen’s complacency and recklessness about the seriousness of the epidemic, and their disrespect of the established maws, orders and regulations of the quarantine. Which made us attempting to shed some light on the criminal responsibility of the non-intentional committed crimes, and the nature of these crimes and how they relate to Corona Virus pandemic.
