الملخص
انفردت النظرية العامة للعقد ولوقت طويل بالثبات والاستقرار، إلا أن التطورات الاقتصادية والاجتماعية وحتى التكنولوجية أثر على المبادئ الكلاسيكية للعقد خاصة في مرحلة تكوينه، وبهدف حماية الطرف الضعيف في العلاقة التعاقدية وعدم اختلال التوازن العقدي، هذا ما جعل الفقه المعاصر يتساءل عن مستقبل النظرية العامة للعقد في ظل انكاس مبادئها، وإذا ما يستدعي ذلك إلى اصلاح النظرية أم تجديدها، وعلى هذا الأساس سنبين في هذه المداخل مواطن انتكاس النظرية العامة للعقد خاصة المبادئ التقليدية في مرحلة تكوين العقد.
