الرقابة على سير الحملة الانتخابية و مضمونها في التشريع الجزائري

الملخص
تعتبر الانتخابات الوسيلة الأساسية في تحقيق التمثيل السياسي، فبها يختار الناخبون من يمثله على المستوى الوطني و المحلي من مؤسسات، و تحرص التشريعات عموما على أن تسير العملية الانتخابية في ظروف جيدة يميزها الشفافية و النزاهة و تكافؤ الفرص بين المترشحين في هذه الانتخابات، و من المراحل التي يجب أن تسود فيها هذه المبادئ نجد مرحلة الحملة الانتخابية التي يقوم فيها المترشحون بعرض برامجهم على الناخبين، و نظرا لأهمية هذه المرحلة و ما قد يشوبها من تجاوزات، فقد نظمتها التشريعات الانتخابية عموما و التشريعات الجزائرية خصوصا بأحكام قانونية تحدد الوسائل الممكن استخدامها من طرف المترشحين في الحملة الانتخابية و الضوابط التي يجب احترامها من طرف الجميع حتى تمر الحملة في شفافية و نزاهة و تمكن الناخب من الاختبار الحر و المناسب. Elections are the primary means of achieving political representation. Voters choose who represents them at the national and local levels from institutions. Legislation generally ensures that the electoral process runs in good conditions characterized by transparency, integrity, and equal opportunities for candidates in these elections. In which these principles must prevail, we find the stage of the electoral campaign in which the candidates present their programs to the voters, and given the importance of this stage and the abuses it may be tainted by, it has been regulated by the electoral legislation in general and the Algerian legislation in particular with legal provisions that specify the means that can be used by the candidates In the electoral campaign and the controls that must be respected by everyone so that the campaign passes in transparency and integrity and enables the voter to have a free and appropriate test.
