تقدير أتعاب المحاماة في التشريع السوداني

الملخص
الملخص: هدفت هذه الدراسة لتناول موضوع أتعاب المحاماة لما له من أهمية عظمى، وبيان نوع المعايير التي يتم الاعتماد عليها في تقدير الأتعاب . تناول البحث تقدير الأتعاب والذي يعتبر سلطة تقديرية للمحكمة، وبيَن البحث أن هنالك عدة أشياء يمكن الأخذ بها لتقدير الأتعاب منها: الجهد المبذول من قبل المحامي، مدى أهميَة الموضوع وصعوبته، خبرة المحامي، سمعة المحامي، والهدف الذي تحقق. تناول البحث موضوع المحكمة المختصة بتقدير الأتعاب وبيَن البحث بأن أي نزاع بين المحامي وموكله يجب أن يقدم به طلباً للمحكمة التي نظرت الدعوى. تطرق البحث ايضاً لدور النائب العام في تعديل اي إتفاق حول الأتعاب بين المحامي وموكله، وذلك بناء على شكوى تقدم له ، إذا تبين له بأن الأتعاب باهظة ولا تتناسب مع ما قام به المحامي من عمل. هذا وقد خلصت الدراسة إلى العديد من النتائج والتوصيات التي يمكن النظر فيها بعين الاعتبار في مرحلة تعديل القانون في المستقبل . Abstract: This study aimed to address the issue of lawyers' fees because of its great importance, and to indicate the type of criteria that are considered to decide the charges fees . The research dealt with the estimate of fees, which falls within the discretion of the court, also the study examined the several elements to be taken into consideration when deciding the amount of fees, including: the effort exerted by the lawyer, the importance and difficulty of the case law, the experience of the lawyer, the reputation of the lawyer, and the objective achieved. The research dealt with the issue of the court competent to estimate fees and the research explained that any dispute between the lawyer and his client must apply to the court that heard the case to decide on it. The research also examined the role of the Attorney General in amending any agreement on fees between the lawyer and his client, based on a complaint filed to the Attorney General, if he finds that the fees are exorbitant and do not correspond to the work of the lawyer or what he will do. The study concluded with many findings and recommendations that could be considered at the stage of amending the law in the future.
