معالجات الادارة لإشكاليات الايتام والمرافق الخاصة برعايتهم

الملخص
الملخص : رعاية الايتام والاهتمام بهم من الامور التي تبنتها الدول من خلال هيئاتها الادارية منذ زمن طويل، فهو واجب من واجبات الادارة بسبب أهمية الموضوع وخطورته، فألى الجانب الانساني الذي يحتم على المجتمع والدولة رعايتهم والاهتمام بهم، هم ايضا مواطنين في بلادهم لهم حقوق عليها، اضافة الى الجانب المتعلق بأمن وسيادة الدولة، فترك هؤلاء الايتام من ايتام ومشردين وكريمي نسب او ضحايا التفكك الاسري والمجتمعي، من دون رعاية واهتمام يؤدي الى انحراف هذه الفئة وضياعها، الامر الذي يشكل مهد للجريمة والخطورة على الافراد والمجتمع والدولة. اما مساعدة الدولة من خلال هيئاتها الادارية لهذه الفئة الخاصة من المجتمع لما تحتاجه من اهتمام تربوي ونفسي واجتماعي ومادي، ومساعدتهم في الاندماج مع المجتمع، يساعد على تجاوزهم لهذه الظروف الخاصة والصعبة الناتجة من الفقد باختلاف صوره، وبالتالي الوصول بهم الى الحياة السوية الطبيعية والسلوك السليم والعمل المنتج والنافع لليتيم ولبلده، لا بل اكثر من ذلك ممكن للهيئات الادارية المختصة بالدولة ان توجه هذه الطاقات وتستثمر رأس المال البشري هذا وتصل بهم الى النجاح والابداع العلمي او الفني او الادبي وغيرها. فدور الادارة في صنع هذه الفئة من ابنائنا وتوجيهها واستثمار هذه الطاقات، كبير جدا ويحتاج الى دراسات ومعالجات وتوضيح لهذا الدور المهم ولتلافي الاشكاليات التي تظهر من خلال العمل والممارسة، فالأيتام في دور الايواء او دور الرعاية للأيتام لديهم الكثير من الاشكاليات، هذا غير الاشكاليات المتعلقة بالمرافق الخاصة برعايتهم، ولاسيما الاشكاليات القانونية في هذا الجانب، وابراز دور الادارة في حلها ومعالجتها هو موضوع بحثنا. Abstract Taking care of orphans and caring for them is one of the things that countries have adopted through their administrative bodies for a long time. The aspect related to the security and sovereignty of the state. Leaving these orphans, the homeless, the generous family, or the victims of family and societal disintegration, without care and attention leads to the deviation and loss of this category, which constitutes a cradle of crime and danger to individuals, society and the state. As for the state’s assistance, through its administrative bodies, to this special category of society for the educational, psychological, social, and financial attention they need, and their assistance in integrating with society, it helps them to overcome these special and difficult conditions resulting from loss in its various forms, and thus lead them to a normal life, proper behavior and work. The product and the benefit to the orphan and his country, but rather more than that, it is possible for the competent administrative bodies of the state to direct these energies and invest this human capital and lead them to success and creativity in the scientific, artistic, literary and others. The role of the administration in making this category of our children, directing them and investing these energies, is very large and needs studies, treatments and clarification of this important role and to avoid the problems that arise through work and practice. Regarding their care, especially the legal problems in this aspect, and highlighting the role of the administration in solving and treating them is the subject of our research.
