تجريم تجنيد الأطفال على ضوء النظام الأساسي للمحكمة الجنائية الدولية

الملخص
تعد فئة الأطفال الأكثر عرضة لانتهاك حقوقها، خاصة وقت النزاعات المسلحة ، ولم يتوقف الأمر على حرمانهم من حقوقهم الأساسية المعروفة، إنما تم استغلالهم أبشع استغلال دون مراعاة لطفولتهم ولضعفهم الجسدي والنفسي، من خلال تجنيدهم في النزاعات المسلحة الدولية و غير الدولية ، باستعمالهم المباشر و غير المباشر في العمليات العسكرية ، لذا فقد جرَّم اتفاق روما 1998، عمليات تجنيد الأطفال و صنفها كجرائم حرب تستوجب المسؤولية و العقاب، وتدخل ضمن الاختصاص الموضوعي للمحكمة الجنائية الدولية ، وفقا للمادتين (5) و (8) من نظامها الأساسي. Résumé La catégorie des enfants est la plus vulnérable à la violation de leurs droits, en particulier en période de conflit armé, Cela ne s'est pas arrêté à les priver de leurs droits fondamentaux et bien connus, mais ils ont été exploités de la manière la plus cruelle sans tenir compte de leur enfance et de leur faiblesse physique et psychologique, en les recrutant dans des conflits armés internationaux et non internationaux, par leur utilisation directe et indirecte dans des opérations militaires. Par conséquent, l'Accord de Rome de 1998 a criminalisé et classé le recrutement d'enfants parmi les crimes de guerre qui requièrent une responsabilité et des sanctions, et relèvent de la compétence de la Cour pénale internationale, conformément aux articles (5) et (8) de son Statut Abstract The category of children is the most vulnerable to the violation of their rights, especially in times of armed conflict, It didn't stop on depriving them of their basic and well-known rights, but they have been exploited the cruelest exploitation without taking into consideration their childhood and their physical and psychological weakness, by recruiting them into international and non-international armed conflicts, by their direct and indirect use in military operations, therefore, the 1998 Rome Agreement criminalized and classified the recruitment of children as crimes of war that require responsibility and punishment, and fall within the subject matter jurisdiction of the International Criminal Court, in accordance with Articles (5) and (8) of its Statute.
