Résumé
Résumé : Notre recherche a pour fin d’étudier un nouveau produit financier mis en place par l’autorité Algérienne en l’occurrence TAKAFUL assurance, qui apparaît par la promulgation d’un nouveau décret exécutif n° 21-81 du 23 février 2021. Le choix de cette recherche est fondé sur les objectifs à atteindre par ce produit sur le marché algérien, on entamant d’aborder le cadre conceptuel et théorique de cet assurance autant que contrat conventionné entre la compagnie d’assurance islamique dite « TAKAFUL » et une personne physique ou moral donnant lieu sur les perspectives et les conditions de son application. La méthode procédée est la méthode analytique descriptive qui convient dans cette recherche utilisant les dispositions légales et règlementaire couvrant l’aspect juridique de ce nouveau produit récemment apparu. Cependant les résultats attendus seront favorables à toute preuve grâce à les dispositions de l’atmosphère financière islamique. Abstract : Our research aims to study a new financial product put in place by the Algerian authority in this case TAKAFUL insurance, which appears by the promulgation of a new executive decree no. 21-81 of 23 February 2021. The choice of this research is based on the objectives to be achieved by this product on the Algerian market; we begin to address the conceptual and theoretical framework of this insurance as much as contract between the Islamic insurance company «TAKAFIL» and a natural or moral person giving rise to the perspectives and conditions of its application. The method used is the descriptive analytical method suitable for this research using the legal and regulatory provisions covering the legal aspect of this newly emerging product. However, the expected results will be favourable to any evidence thanks to the provisions of the Islamic financial atmosphere.
