التّناولُ الأصوليُّ للمندوبِ " ثغراتٌ ونظراتٌ" The Fundamentalist Approach To The Desirable "the Visions And The Gaps"

الملخص
الملخص بالعربية يروم هذا البحث نقد التناول الأصولي للمندوب من ثلاثة جوانب: جانب الصياغة المفهومية، وجانب الانتماء إلى دائرة التكليف، وجانب البعد الوظيفي، وهو نقد مشفوع باقتراح معالم تجديدية كفيلة بسدّ ثغرات هذا التناول. وقد توسل البحث بالمنهجين الاستقرائي والتحليلي، وخلص إلى نتائج، من أهمها: أن مراتب المندوب تُميَّز في ضوء معيارين رئيسين: أولهما: معيار دليل الطَّلب، ومنه تؤخذ درجةُ التأكيدِ على الفعل، عاليةً كانت، أو متوسِّطةً أو نازلةً، ومدارُ هذا المعيارِ النصيِّ على ثلاثة أمور رئيسة: قوّةِ الدّلالة اللفظيَّة على تأكّد الحكم، وتضافرِ الأدلة، وإفادةِ الملازمة وكثرة الفعل ووفور الثواب. والثاني: معيارُ وزن المصلحةِ، وهو متفرِّعٌ _ في معتاد أحوال الشرع وتصاريفهِ _ عن الأول؛ لأن الأصل أن ما عظمت مصلحته، ندب الشارع إليه بدرجةٍ عالية من الطلب. الكلمات المفتاحية: المندوب، علم أصول الفقه، النقد، المقاصد Abstract This research aims to critique the fundamentalist approach to the desirable through three aspects: the conceptual formulation aspect, the aspect of belonging to the assignment department, and the aspect of the functional dimension, which is a critique accompanied by the suggestion of innovative milestones capable of bridging the gaps in this approach. The research resorted to the inductive and analytical approaches, and came to conclusions, the most important of which are: The ranks of the desirable are distinguished in the light of two main criteria: the first: the criterion of evidence for the request, from which the degree of emphasis on the action is taken, whether high, medium, or descending. Inheritance and frequent action and abundant reward. The second: the criterion for weighing the interest, which is a branch - in the usual conditions and expenses of Sharia - from the first; Because the principle is that the greater his interest, the legislator urged him to him with a high degree of demand. key words: The desirable, the science of the principles of jurisprudence, criticism, the purpose
