الحماية القضائية للمحجور عليه Judicial Protection Of Persons Placed Under Deprivation Of Legal Rights

الملخص
يلعب القضاء دورا مهما في تدعيم النصوص القانونية لحماية المحجور عليهم من مختلف أوجه الاستغلال والغبن والتعديات المرتكبة عليهم، فتوقيع الحجر يتطلب أولا تأكد القضاة من الصفة المستدعية له مع ضرورته، ويثبت الحجر بحكم قضائي يعين القاضي من خلاله النائب المناسب للمحجور عليه، وهذا بعد إتباع الإجراءات اللازمة له، بعدها تخضع تصرفات المحجور عليه لأحكام خاصة تختلف حسب نوعية العارض وطبيعة التصرف المبرم من طرفه. Justice plays an important role in consolidating legal texts in order to protect persons under deprivation of legal rights against various forms of exploitation, wrong and violations committed against them. Before signing deprivation of legal rights, Judges must first of all be certain of the quality requiring the recourse to the deprivation of legal rights and the necessity of this latter. Deprivation of legal rights must be proved by a judgment whereby the judge appoints the suitable counsel for the person placed under deprivation of legal rights by abiding by required procedures related to the deprivation of legal rights. Then, the acts of the person placed under deprivation of legal rights will be under special stipulations different from the quality of the incident and the nature of the act concluded by the person placed under deprivation of legal rights.
